799 Wednesday April 30th. ,1913. Continued. SIDEWALK IMPR3VEMENT RESOLUTION NO. 264. Resolved by the Board of Public Works of the City of South Bend,St. Joseph County,State of Indiana.That it is deemed necessary to improve PORTAGE AVENUE FROM THE NORTH LINE OF MORRIS PARK ADDITION TO THE NORTH LINE OF SECTION 341' 36 N.R. 2 E. By grading the said street from property line to property line and constructing cement curb and cement walks on both sides of said Portage Ave. from the north line of .Morris Perk Addition to the North line of Section 34 T.37 N.R. 2 East. And such improvement is now ordered, in accordance with the profile, details, drawings and specifications on file in the office of the Department of the Board of•Publie Works of said City; -and such improvement is now ordered. The cost of said improvement,including the cost of street and alley inter@ sections, shall be assessed upon the real estate abutting on said PORTAGE AVENUE all according to the method and manner provided for in an Act of the General Assembly of the State of Indi—. ana,entitled "An Act Concerning Municipal Vorporations," approved March 6219052and in accord- ance with and pursuant to the provisions of all~amendatory and supplemental acts thereto, passed by the General Assembly -of the State of Indiana;Assessments,if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment of such work unless the property owners pay said assessment before; said bond or bonds are issued. tinder no' cir cumstances shall the City of South Bend, be, or be held responsible for any sum or sums, due from said pro— perty owner or owners for said work or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assess— ments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All propeedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bonds therefor, 'shell be _as provided for in said above entitled Act and amendments thereto. ° Notice of this resolution shall be published on. the 6th. day of .May 1913 and on the 13th. day of May,1913 in the South Bend Daily Times. This Board will give a hear— ing on this resolution, in its office in the City Hall on the 13th. day of June,1913 at 7:45 P.M. Adopted this 30th. day of April,1913. BOARD OF PUBLIC_ @VORKS. CONDEMNATION RESOLUTION NO.27.19130 Resolved by the Boardof Public Works of the City of South Bend, Indiana, That the following described property be--wpnvepriated for the use of said City: Beginning on the westerly lime of Portage Ave, end the north line of Morris Park Addition;thence westerly at right -angles to said Portage Ave'.' acid "d3's'tahbe' of fifteen feet; thence northwesterly par— allel with and fifteen ft. westerly from the westerly line of said Portage Ave. to the North line of Section 34 N.R. 2 E. thence east to a point fifteen feet easterly from the easterly line of said Portage Ave. measured at right angles, thence southeasterly parallel with and fifteen feet easterly from -the easterly line of said Portage Ave. to a point due east to the point of beginning thence west to the place of beginning. The above description, is a strip of land fifteen feet wide on both sides' of Portage Ave, king Portage Ave. ninety feet wide in- stead of sixty as laid out. ° The following described property may be injuriously of beneficially of—. feeted by such apporpriations: Beginning on the westerly line of Portage 4ye. and the north line of Morris Park Addition thence west one Hundred and sixty five (165i'hence northerly parallel with and one hundred and sixty five (165) feet westerly from the westerly line of said Portage Ave. to the north line of Section 34 T. 39 N.R. 2 E. thence east along the north lime of section 34 to a point one Hundred and sixty five feet east of the easterly line of Portage Ave. thence southeasterly parallel with and one hundred and sixty five (165) feet easterly; from the easterly line of said Portage Ave. to a point due east of the place of be— ginning; thence west to the place of beginning. The purpose of such appropriation is VVIDENING OF PORTAGE AVE. FROM SIXTY (60) ft. to ninety (90) feet by appropriating a strip of land fifteen feet wide on both side of said Portage Ave -as now laid out. ?'
