The same was referred <br />to the City Civil Engineer. <br />/Petition received for condemnation of alley from Indiana Avenue to Perley Street. <br />The same was referred to the City Civil Engineer. <br />SIDEWALK IMPROVEMENT RESOLUTION No. 254. <br />Resolved by the Board of Public Works of the City of South Bendri it Joseph <br />County, State of Indiana, That 'it is deemed necessary to improve ST. LOU.IS STREET FROM <br />CORBY STREET TO ST. 'VINCENT STREET. By "grading the said street from property line to <br />property line and constructing cement curb and cement walks on both sides of said street <br />And such improvement is now ordered, An accordance with the profile, details, drawings <br />and specifications on file in the office of the Department of the Board of Public Works <br />of said City; and such improvement is now ordered. <br />The cost of said improvement, including the cost of street and alley inter— <br />sections, shall be assessed upon the real estate abutting on said ST LOUIS STREET all <br /># according to the method and manner provided for in an Act of .the General Assembly of the <br />Street of Indiana, entitled "Are Act Concerning Municipal Corporations," approved Larch <br />61,1905 and in accordance with and pursuant to the provisions of all amendatory and <br />supplemental acts thereon, passed by the General Assembly of the State of Indian,. <br />Assessmenta, if deferred, are to -be pid in ten equal annual installments, 14 th interest <br />at the rateof Six per cent per annum. A Bond or bonds shall be issued to the con. — <br />tractor in payment of such work, unless the property owners gay said assessment before <br />said Bond or bonds are issued. Under no circumstances shall eht City of South Be.d, <br />be, or be held responsible for any sum or sums, due from said property owner or owners <br />for said work or for the collection_'of the same, or for the payment of any bond, bonds, <br />certificate or certificates, issued to said contractor in payment for such work, except <br />for such moneys as shall have been actually received by the City from the assessment for <br />such improvement, or such moneys as said City is by said above entitled Act required <br />to pay.. All proceedings had, and work done in the making of said improvement, assess— <br />ments of property, collection of assessments and issuance of bonds therefor, shall be as <br />provided for in said above entitled Act and amendments thereto. <br />Notice of this resolution shall be published on the 3rd. day of ,May ,1913 <br />and on the loth. day of May,1913 in the South Bend Daily Times.
