7.4 6 GRADE .CURB AND SIDEWALK IMPROVEMENT RESOLUTION NO. 242. Resolved by the Beard of Public Works, of the City of South Bend, St. Joseph County, State of Indiana, That it is deemed necessary to improveTHAT an improvement be made of the kind, size, location and terminal points as follows: — That bids be received for the construction and repairing of Cement Walks and Curbs on dUferent Streets in the City where the same has already been partly constructed or is defective. Allwork to be constructed or repaired in accordance with Standard specifications on file in the office of the City Engineer of said City* All work to be done and assessments wade as provided in Section 1 of an Act -entitled "An Act concerning Municipal Corporations,approved 1909* in accordance with the profile, details, drawings and specifications on file in the office ofthe Department of the Board fff Public Works of said City; and such impeove- ment is now ordered. The cost of said improvement, including the cost of street and alley intersections, shall be assessed upon the real estate abutting on said VARIOUS STREETS all according to the method and manner provided for in an Act of the General Assembly of the State of Indians,, entitled "An Act Concerning Municipal Corporations," approved March 611905, and in accordance with and pursuant to the provisions of all amendatory and supplemental acts thereto, passed -by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal. annual installments, with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the Contractor in payment of such work, unless the property owners pay said assessment before said bond or bonds are issued. Under no circumstances shall the City of South Bend be, or be held responsible for any sum or sums, due from said property owner or owners for said work or for the col— lection of the same, or for the payment of any bond, bonds, certificate or certi— ficates, issued to said contractor in payme-it for such work, except for such moneys as shall have been actually received by the City from theassessments for such im— provement, or such moneys as said City is by said above entitled 1ket required to pay All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act and amendments thereto. Be it resolved that notices be published in ,the .South Bend Daily Times on the 27th. day of March and. on the 3rd. day of April 1913 : to. the .effect that this Board - ll receive .bids forsaid improvement up to 10:00 A.M. on the nth. day of MAy,1913.
