726 <br />Friday March 7th. 1913. <br />Board met in regular session at 10:00 A.M. All members present. <br />`Representative of the Indiana & Michigan Electric Company appeared before the Board <br />asking for a temporary permit for the placing of twelve (12) poles on the East side of <br />South Chapin Street south from the Grand Trunk tracks. The same was approved subject to <br />the Ordinance governing the Under -ground district. <br />d Clerk made a repDrt of the balances for the month of February 1913. <br />PIPE SEVER IMPROVEMENT RESOLUTION NO. 232. <br />Resolved by the Board of Public Works of the City of South Bend, <br />j County of St. Joseph, State of Indiana. That the construction of a local sewer, in- <br />tended and adapted only for local use by the property holders whose property abuts there <br />on and not intended or adapted for reciving sewerage from collateral drains, be and the <br />same is, hereby ordered in and along Kenwood Avenue, Anthony Street and Bertrand Street <br />from Meade Street to a point about 40 of McCartney Creek, as, follows to-Vit <br />Beginning at the intersection of Meade Street and Kenwood Avenue, thene <br />thnee west along the center of Kenwood Avenue to the center of Anthony Street with a <br />20 inch vitrified pipe sewer, thence north ,along the center of Anthony Street to the <br />center of Bertrand Street with an 18 inch vitrified pipe sewer, thence west along <br />Bertrand Street 1293 feet with an 18 inch vitrified pipe sewer, thence northwesterly <br />220 feet to a point 40 feet east of McCartney Creek with an 18 inch vitrified sewer. <br />Together with the necessary manholes, Inlets and House Connections to the curb line <br />along the line of improvement. All as shown on the plans, and in accordance with the <br />profiles, detail drawings and specifications on file in the Office of the Department of <br />Publi a Works of the City of South Bend, Indiana. <br />And such improvement is now ordered and said sewer with all its <br />appurtenances shall be constructed in accordance with the profile and specifications <br />now on file in the office of the Department of Public Works of said City. The cost of <br />said improvement shall be apporitioned against and paid by the property holders whose <br />property abuts thereon, and upon the City of South Bend if the City is benefited by said <br />improvement , all according to the method and manner provided for in Act of the General <br />Assembly of the State=of Indiana, entitled "An Act Concerning municipal Corporations," <br />approved-Mareh 6th. 1905• Assessments, if deferred,, are to be paid in ten equal annual <br />installments, with interest at the rate of Six per cent per annum. A bond or bonds <br />shall be issued to the contractor in payment for such work, unless the property owners <br />pay said assessments before said bond or bonds are issued. -Under no circumstances shall <br />the City of South Bend be or be held responsible for any sum or sums due from said <br />property owner or owners for said work, or for the collection of same, or for the paymen <br />of any bond or bonds, certificate or certificates, issued to said contractor in pay- <br />ment for such w kk, except for such moneys as shall have been actually received by the <br />City from the assessments for such improvement, or such moneys as said City is by said <br />entitled Act required to pay. All proceedings had, and work done in the making of said <br />I mprovement assessment of property, collection of assessments and issuance of bonds <br />therefor, shall be as provided for in said above entitled Act. <br />Notice of this resolution shall be published on the llth. day <br />of Larch 1913 and on the �lgth. day of March 1913 in the South Bend Daily Times. This <br />Board will give a hearing on this resolution at its office in the City Hall on the llth, <br />day If April 1913 at 7:45 P-M- <br />Adopted this seventh day of March 1913• <br />BOARD OF PUBLIC VCRKS. <br />
