�06 SIDEWALK IMPROVk ENT RESOLUTION NO. 224. ✓ Resolved by the Board of Public Works of the City of South Bend, St: Soseph County, State of Indiana, That it is deemed necessary to improve JOFWSON STREET AS NOW PLATTED AND LAID OUT IN MAYRI S MICIaGAN AVENUE ADDITION. By grading said Johnson Street its full width as now laid out and platted in Mayrt s Michigan Avenue Addition, and the construction of cement sidewalk and cement ct rk on west side of said street. All as shown on the plans, and is accordance with the profiles, detail drawings and specifications on. file in the office of the Departs. ment of Public Works of said City. And such improvementis now ordered in accordance with the profile, de- tails, drawings and specifications on file in the office of the Departent of the Board of Public Works of said City; and such improvement is now ordered. The cost of said improvement,including the cost of street add alley inter- sections, shall be assessed upon the real estate abutting on,said JOHNSON STREET all according to the method and iaanner provided for in an Act of the General Assembly of the State of Indiana, enti tled, "An Act Concerning Municipal Co rpo rat ions p A approved March E11905, and in accordance wit and pursuant -to the provisions of all amendatory and: supplemental acts thereto, passed by the era l Asaezhly of the State of Indiana. Assessments,, if deferred, are to be paid in ten equal annaal installments, with inter- est at the rate of Six per cent per annum. A Bond or bonds shall be issued to the contractor in payment of such work, unless the property owners pay said assessment be- fore said bond or bonds are i sued. Under no circumstances shall the City of South Bend, be, or be Meld responsible for any sua or sums, due from said property owner or owners for said work or for the collection of the same, or for the payment of am .bond bonds, certificate or certificates„ issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assess ents for such improvement or such moneys as said City is by said above en- titled Act rwquifted to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and .issuance of bonds thereofr, shall be as provided for in said above entitled Act and amnedments thereto. Notice of this resolution shall be published on the 14th. day of February 1913 and on the 21st. day of February 1913 in the South Bend Daily Times, This Board will give a hearing on this resolution in its office in the City Hall on the 20th. day of March,1913 at 7:45 POM.
