<br />Board met in regular session at 10:00 A.M. All members present.
<br />Grade, curb and walk on Emerick Street under Impm vement resolution No. 156 was
<br />awarded to H. N. Barnes.
<br />Grade, curb and walk on Howard Street from South Bend Avenue to E. line of More,yt s
<br />1st. addition, under improvement resolution No. 154. was awarded to H.N. Barnes.
<br />,�Crade, curb and walk on Howard Street from Notre Dame to Eddy Street, under improves
<br />merit resolution No. 153 was awarded to Hugh Anderson.
<br />Grade, curb and walk-on Kinyon Street from Portage Avenue to the west line of
<br />Morris Park Addition,under improvement. resolution No. 169. -was awarded to H. W
<br />Reed be Sons.
<br />Pipe Sewer on Marion Street from Lafayette Street to 60 ft.: West of
<br />Main, under improvement resolution No. 1591, was awarded to Hoban & Roach.
<br />t-- Trunk Sewer on Main Street from Indiana Avenue to Ewing Avenue, under Improvement
<br />resolution No. 176. was awarded -to Henry DeVo s.
<br />✓Petition received, read and placed on file asking for a street light at the corner
<br />of Cleveland Avenue and Vassar Avenue. The same was referred to hhe 'Street -Cem-
<br />missioner for investigation .
<br />Engineer filed assessment roll and final estimate fo-r Pipe Sewer on Miner:::St-rett
<br />from Notre Dame St re et to Eddy St reet , under improvement Resolution No. 137.
<br />Resolved, that noticese as to the amounts of assessments be published
<br />for six c.onse ctut i ve days in the South Bend Daily Times, commencing on the 15t h.
<br />day. of Jule 1912, stating that this Board will give a hearing on the amount of such
<br />assessments at its office in the City Hall on the 26th. day of July 1912 at 7:45P.M
<br />Resolved further, that the entire work under the above contracts be
<br />accepted and approved and the final estimate thereon allowed. Notice of this
<br />resolution shall be published on the 15th. day of July 1912 in the South Bend Daily
<br />Times, stating that this Board will give a hearing on the acceptance of such work
<br />at its office in the City Hall on the 26th. day of July 1912 at 7:45 P.M.
<br />GRADE, CURB AND WALK IMPROVEMENT RESOLUTION
<br />NO. 193.
<br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA
<br />ST. JOSEPH COUNTY,STATE OF INDIANA; That it is deemed necessary to improve O'Brien
<br />St re et from .the north line of Mi chi gan Avenue to the North line of Mayr' s Addition
<br />by grading the said street from property line to property line and constructing cem
<br />ent walks and cement curb on both sides of said street, All as shown on detail
<br />plans, profiles and specifications on file in the Office of the Department of Board
<br />of Public Works of said City. And such improveir..ent is now ordered, in accordance
<br />wJbth the profile, details, drawings and specifications on file in the office of the
<br />Department of the Board of Public Works of said City; and such improvement is now d
<br />ordered. The cost of said improvement, including the cost of street and alley inte
<br />intersections, shall be assessed upon the real estate abutting on said O'Brien Stre
<br />Street all according to the method and manner provided for in an act of the General
<br />Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corpor-
<br />ations, "approved March 6, 1905, and in accordance with and pursuant to the pro-
<br />visions of all amendatory and supplementary acts thereto, passed by the General
<br />Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten
<br />equal annual instaIlments, with interest at the rate of Six per cent per annum.
<br />A bond or bonds shall be issued to the contractor in payment of such wnrk,unless
<br />the property owners pay said assessment- before said bonds or bonds are issued. -
<br />Under no circumstances shall the City of South Bend, be, or be held responsible
<br />;or :any , sum: or sums, due from said property owner or owners for said werk �or for
<br />the collection of the same, or for the payment of any bond, bonds, certificate or
<br />certificates, i sued to said contractor in payment for such work, except for such
<br />moneys as shall have been actually received by the City from the assessments for
<br />such_ improvement, or such moneys as said City is by said above entitled Act re-
<br />quired to pay. All proceedings had, and work done in the making of said improve-
<br />ment, assessment of property, collection of assessments and issuance of bonds there
<br />for,, shall be as provided for in said above entitled Act and amendments thereto.
<br />Notice of this resolution shall be published on the 10th. day of
<br />July 1912 and on the 17t h. day of July 1912 in the South Bend Daily Times. This
<br />Board will gkve a hearing on this resolution in its office in the City Hall on the
<br />9th.. day of A ugust at 7:45 P.M.
