<br />Walsh & Kelly, Inc recognizes the importance of assuring proper administrative and
<br />operational decisions and actions in the asphalt paving industry..Werecognize the need
<br />to even those individuals who might endanger themselves through the abuse of'alcohol or
<br />controlled substances (drugs) In order to mitigate the risks, which result from, being
<br />under the influence of alcohol or drugs, the management of Walsh &Kefly, Inc will
<br />enforce unnurni testing for determination ru'ability to work and disciplinary action as
<br />described in the Following policy documentation
<br />Furthermore, Walsh & Kelly, Inc does not allow, condone the consumption, or use of
<br />illegal controlled substances (drugs) during working hours or on company property Any
<br />possession, consurnintion, or sale of controlled subsiances, on company property or

<br />The consumption of alcohol is likewise prohibited, with the cyception of social events
<br />sanctioned by senior management ofWalsh & Kelly, Inc where and when manufacturing
<br />work is not taking place Any consumption of alcohol on company property, is strictly
<br />forbidden and mill result in ferntination
<br />Management or Walsh & Kelly, Inc.also reserves the right to search all company
<br />property, including, but not limited to, employee desks and lockers, cramptury cars, tool
<br />boxes, etc to prevent violations of this policy or for any other legitimate reasons Entry

<br />cooperate with a search will not be showed to remain on company property and will be
<br />subject to termination.
<br />In order to consistently meet the standards of the Walsh and Kelly Substance Abuse
<br />Program and the requirements of the Indiana Department of Transportation (DOT)
<br />requirements, Walsh and Kelly, Inc "ill use the Building & Combustion Resource
<br />Center, Inc, (BCRC) and the Indiana Construction Amornsfion's (ICA) Substance Abu u
<br />Programs found in Appendixes 1. 2, and 3 of this document
<br />Ea. PERSONS SUBJECT TO THE SUBSTANCE ABUSE PROGRAM
<br />The Walsh & Kelly, Inc Substance Abuse Program applies to all Walsh & Kelly, Inc
<br />employees, including employees under collective bargaining agreements

<br />Walsh & Kelly, Inc reserves the right to change the provisions of this policy, including
<br />the uniform testing procedure and disciplinary action at any future time
<br />V, SUBSTANCE ABUSE PROGRAM COORDINATORS
<br />The coordinator for Walsh & Kelly, Ins,' Substance Abuse ft.gounthull be Heritage
<br />Group Safety (iGS) LOS shall review the program periodically and same as the
<br />recipient of the last results from the Medical Review Officer (MRO) for testing done in
<br />accordance with the DOT regulations or from the clinic for non -DOT testing
<br />The Medical Revice, Officer is the medical director or designate of the company -
<br />designated program conducting the substance abuse testing The MRO receives results
<br />from the NIDA - certified testing laboratory and/or Breath Alcohol Technician on
<br />substance abuse test results, delearmines, the basis for "positives", and communicates the
<br />recalls to the compani
