ARTICLE IX
<br />Section 1 - Affirmative Action
<br />The Union agrees to participate in an Affirmative Action Program that is agreed upon between the Union and
<br />the Michiana Builders Association, Inc. or to participate in an existing plan known as the South Bend Home Town Plan.
<br />Section 2 - No Discrimination
<br />It is understood and agreed that the Employer shall not discriminate against any member of the Union, any of
<br />its Officers, its Stewards, or any member serving as a member of a committee authorized by the Union. In the
<br />application of provisions of this Agreement, there shall be no discrimination by the Employer or the Union against any
<br />individual because of such individual's race, color, religion, sex, age or national origin, and when the words in the
<br />masculine are used herein it shall include the feminine.
<br />ARTICLE X
<br />Section 1- Savings Clause
<br />Any provision contained herein that is contrary to or held to be in violation of the Labor Management Relations
<br />Act of 1947, or any federal or state law now in force or hereafter enacted, or hereafter becoming effective shall be void
<br />and of no force, or effect, and this contract shall be construed as if said provision herein were not a part hereof, it being
<br />intended, however, that the other provisions of this contract shall not be affected thereby.
<br />It is further agreed that should compliance with any federal or state law, or amendment thereof, or any order or
<br />regulation issued there under, now or hereafter in force and effect prohibit the carrying out of any of the provisions of
<br />this Agreement, then to the extent of such deviation or prohibition, this Agreement shall be deemed to have been
<br />automatically amended, effective on the effective date of such law, order or regulation.
<br />Such amendment to this contract shall remain in effect only so long as said law, amendment, order or regulation
<br />continues in force, or until the expiration of this Agreement, whichever event shall first occur.
<br />Section 2 - UNIFORMITY
<br />In the event that any other Employer or Employer group reaches an agreement with the Union covering the
<br />same work as this Agreement, that is any more favorable than a term of this Agreement, then at the option of Michiana
<br />Builders Association such more favorable provisions shall become a part of this Agreement, as of the effective date of
<br />the more favorable provision. The Union shall notify, by certified mail within seven (7) calendar days of entering into
<br />any agreement with any other employer or employer group covering the same work as is covered by this Agreement,
<br />the Michiana Builders Association and provide it with a copy of any other labor agreement now or hereafter negotiated
<br />with anyone else covering the same work as this Agreement but containing any different terms and conditions. The
<br />Michiana Builders Association shall notify the Union, by certified mail within seven (7) calendar days, of its intent to
<br />utilize the more favorable terms.
<br />During the term of this Agreement, Michiana Builders Association may request the Union to provide a list of
<br />employers who have signed a Memorandum of Understanding adopting the terms of this Agreement.
<br />ARTICLE XI
<br />Section 1- Credit Union Deductions
<br />The Company agrees that upon receipt of properly executed Voluntary Payroll Deduction Authorizations they
<br />shall make payroll deductions from the same pay period each month. Such deductions shall be on constant amounts on
<br />behalf of employees that are members of Local 150, I.U.O.E., Credit Union. Deductions shall be prior to the twentieth
<br />(20th) day of each month. Remittance of the accumulated deductions of the previous month, with a list indicating the
<br />name, social security number and amount remitted for each member, will be made for each member to the Local 150,
<br />I.U.O.E., Members Credit Union, 6240 Joliet Road, Countryside, Illinois 60S25.
