Section 3. The Employer shall obtain the surety bond in the required amount, from a pre - <br />approved list of acceptable surety bond companies provided by the Fringe Benefit Funds, <br />and the benefit funds specified in this Agreement shall be the sole beneficiaries of the <br />bond. The bond will be given to the Fringe Benefit Funds where it will be kept. <br />Section 4. Should an Employer fail or refuse to provide the required surety bond, or should <br />an Employer fail to keep a bond in effect at all times, the Union shall have the right to <br />strike and/or picket, after notice, and use all other legal and/or economic means to cause <br />the Employer to comply with this Article. <br />ARTICLE XXXV <br />HEALTH CARE <br />Section 1. Should either the State or Federal Government pass legislation mandating all <br />Employers to participate in a national or statewide health care plan, it is agreed by the <br />Parties to this Agreement to automatically open this Agreement within thirty (30) days of <br />such passage to discuss same. <br />ARTICLE XXXVI <br />BCRC/DRUG TESTING <br />Section 1. The Union recognizes the right of the Employer to establish a drug testing <br />policy for Employees. <br />Section 2. In all situations where an Employer is required to agree to a testing program in <br />order to qualify to be the successful contractor on a project, testing may be required, in <br />accordance with the standards of this program, or, if the owner's requirements for <br />successful contractors are more stringent, in accordance with the owner's requirements. <br />No adverse employment action shall be taken against a worker solely because he/she <br />refused a job assignment that has a substance testing requirement. <br />Section 3. BCRC <br />(A) The Association, the Union, various other Employer Associations, and various <br />other unions are members of the Building and Construction Resource Center, <br />Inc. (hereinafter `BCRC"), a non-profit corporation that was formed to provide <br />services in the construction industry, including, but not limited to, education and <br />referral services concerning alcohol, drug and other substance abuse, which <br />39 <br />
