(a) The Indiana Department of Labor or a prosecuting attorney gives written notice <br />to the EMPLOYER that the EMPLOYER is violating the Indiana Right -to -Work <br />Law by continuing to withhold union dues and assessments from an Employee; <br />(b) The Indiana Department of Labor or a prosecuting attorney files a complaint <br />against the EMPLOYER that alleges that the EMPLOYER is violating the <br />Indiana Right -to -Work Law by continuing to withhold union dues and <br />assessments from an Employee; or <br />(c) The Employee files a complaint in a court of competent jurisdiction that alleges <br />that the EMPLOYER is violating the Indiana Right -to -Work Law by continuing <br />to withhold union dues and assessments from the Employee. <br />If the result of any of these proceedings is that the contested check -off form is found to <br />be legal once the final decision is reached and the time for any appeals has expired, then <br />the check -off shall be automatically resumed on the day after the decision or the <br />expiration of any appeal period. During the pendency of any such action the contested <br />deductions may be placed in the UNION's dedicated escrow account if the Employee, <br />EMPLOYER, and the involved agency are agreeable. <br />Section 2. Revocation of dues check -off shall be in accordance with Federal Law. <br />Section 3. INDEMNITY. The UNION shall defend, indemnify and save t <br />EMPLOYER harmless against any and all claims, demands, suits or otherforms of liabili <br />i <br />that may arise out of or by reason of action taken or not taken by the EMPLOYER for t <br />purpose of complying with the provisions of Section 3 relating to Dues and Assessmen <br />Section 4. FEDERAL LAW. The provisions of this Article shall be interpreted in <br />11 <br />fashion consistent with federal and state law. <br />ARTICLE III <br />WAGES, FRINGES AND INDUSTRY FUND <br />Section 1. WAGES, SAVINGS FUND, DUES AND ASSESSMENT <br />CHECK OFF. <br />The minimum hourly rate of wages shall be as follows: <br />(a) Joumeyman/Carpenter - $37.42 per hour (6/1/15 thru 12-31-15). <br />(b) Working Foreman — 7% per hour above journeyman rate. <br />(c) Working General Foreman — 10% per hour above journeyman rate. <br />(d) At the direction of the UNION and with the signed authorization of the <br />Employee, the EMPLOYER shall deduct from the Employee's wages, an amount of $2.00 <br />per hour for savings purposes and transmit same to a depository designated by the <br />UNION, with completed forms supplied by the UNION. <br />Payments for the amounts so deducted and the completed forms shall be <br />postmarked no later than the 20th of the month following the close of the preceding month. <br />
