RESOLUTION NO. 3064 <br /> A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br /> AMENDING THE DEVELOPMENT PLAN FOR <br /> THE SOUTH BEND CENTRAL DEVELOPMENT AREA <br /> AND ADOPTING THE MASTER PLAN FOR THE <br /> HOWARD PARK NEIGHBORHOOD <br /> WHEREAS, the South Bend Redevelopment Commission (the "Commission"), <br /> governing body of the City of South Bend, Indiana, Department of Redevelopment (the <br /> "Department") and the Redevelopment District of the City of South Bend, Indiana (the <br /> "Redevelopment District"), exists and operates under the provisions of the Redevelopment of <br /> Cities and Towns Act of 1953 which has been codified in IC 36-7-14 et sue., as amended from <br /> time to time (the "Act"); and <br /> WHEREAS, the Commission has previously designated and declared an area in <br /> the City of South Bend, Indiana (the "City") known as the South Bend Central Development <br /> Area to be a blighted area within the meaning of the Act and adopted a Redevelopment Plan (the <br /> "Redevelopment Plan") all pursuant to Resolution No. 137 adopted by the Commission on May <br /> 10, 1 985 (the "Declaratory Resolution"); and <br /> WHEREAS, pursuant to Section 16(a) of the Act, the Declaratory Resolution <br /> was approved by a resolution of the St. Joseph County Area Plan Commission (the ",Plan <br /> Commission"), constituting its written order approving the Declaratory Resolution and the <br /> Redevelopment Plan (the "Plan Commission Order"); and <br /> WHEREAS, pursuant to Section 16(b) of the Act, the Common Council of the <br /> City adopted its resolution which approved the Plan Commission Order; and <br /> WHEREAS, after notice and a public hearing thereon, the Declaratory <br /> Resolution was subsequently confirmed by the Commission; and <br /> WHEREAS, pursuant to the Act and the Redevelopment Plan, the Department <br /> has conducted surveys and investigations and has thoroughly studied the South Bend Central <br /> Development Area and the Howard Park Neighborhood; and <br /> WHEREAS, upon such surveys, investigations and studies having been made, <br /> the Commission finds that the Redevelopment Plan cannot be achieved by regulatory processes <br /> or by the ordinary operations of private enteiprise without resort to the powers allowed under the <br /> Act and that the public health and welfare will be benefited by the accomplishment of an <br /> amendment to the Redevelopment Plan; and <br /> WHEREAS, the Commission desires to amend the Redevelopment Plan by <br /> adopting a Master Plan for the Howard Park Neighborhood (the "Amendment"); and <br /> WHEREAS, the Amendment adopts only the portion of the Master Plan lying <br /> inside and related to the South Bend Central Development Area (depicted in Exhibit A); and <br />
