Property Insurance: <br />Fire and extended coverage in an amount equal to 100% of the full replacement <br />value of the improvements on the Property. <br />Grantee is a municipal corporation organized under the laws of the State of Indiana and is <br />self -insured under provisions of Indiana statutes and local ordinance. Grantee maintains blanket <br />insurance coverage over real and personal property and is covered by a non -reverting insurance <br />premium and liability reserve fund created by the City of South Bend, Ordinance # 6657-79, <br />pursuant to Indiana Code § 34-13-3-4, as amended from time to time. Grantee, at its sole cost <br />and expense, shall insure its activities in connection with this Agreement and obtain, keep in <br />force, and maintain a general liability self-insurance program and workers' compensation as <br />required by Indiana law. <br />6.0 Breach of Agreement. <br />In the event that Grantee fails to make payments as provided in this Agreement or <br />breaches any covenant, restriction or condition set forth in this Agreement, Grantor shall provide <br />Grantee with 30 days written notice of said breach, and if Grantee fails to cure said breach within <br />fifteen (15) days of receiving said notice, the entire remaining license fee due under this <br />Agreement shall immediately become due and payable without further notice or demand. In the <br />event of such default by Grantee, Grantee shall immediately deliver the Property to Grantor and <br />said delivery shall not impact the obligations of the Grantee under the terms of this Agreement. <br />In the event that the Grantor is required to use legal process to enforce the provisions of this <br />Agreement, Grantee agrees to pay the reasonable and necessary costs incurred by Grantor, <br />together with the reasonable attorney's fees provided, however, that Grantor is the prevailing <br />party. Should Grantee be the prevailing party, the parties shall each bear their own fees and <br />expenses. <br />4 <br />
