COUNCIL RULES <br />3:48 P.M. <br />JULY 25, 2012 <br />Committee Members Present: <br />Derek Dieter, Dr. Fred Ferlic, Dr. David Varner, Karen White <br />Other Councilmember's Present: <br />Tim Scott <br />Other's Present: <br />Mike Schmuhl, Kathy Cekanski - Farrand <br />Agenda: Preliminary Review of Complaint filed by Henry Davis Jr. <br />Council President and Rules Committee Chair Derek Dieter opened the meeting by <br />stating an official complaint had been filed by Councilman Henry Davis against fellow <br />Councilman Dr. Fred Ferlic and against Police Chief Chuck Hurley. <br />Derek then asked Council Attorney Kathy Cekanski - Farrand to explain the protocols <br />dictating where we go from here. <br />Kathy began by suggesting Dr. Ferlic recuse himself from the Rules Committee for the <br />time it deals with the complaint filed against him. Dr. Ferlic did so. <br />Kathy noted that the governing South Bend Municipal Code provisions permit its Council <br />Rules Committee to have the assistance of the City Attorney, Council Attorney or outside <br />Legal Counsel. She suggested that the complaint could be referred to the City Attorney <br />Aladean DeRose and herself for a procedural recommendation to be given to the <br />Committee within 10 business days (Aug. 8) <br />Dr. Varner motioned that referral. Karen White seconded and all agreed. <br />In the matter of the complaint against Chuck Hurley, Kathy said in that the Chief was a <br />department head it would be up to the City Administration to follow through according to <br />their own protocol. <br />There being no further business to come before the committee at this time, Chairperson <br />Derek Dieter adjourned the meeting at 4:10 p.m. <br />Respectfully Submitted, <br />erek "DDiete'r, Chairperson <br />Council Rules <br />
