Previously Employed Workers <br />Employees that have not been employed by Bowen for <br />period of three (3) months or longer, will be considered a <br />new hire and be subject to fulfill the pre -employment <br />requirements of this Policy. <br />3. OWNER MANDATED PRE -EMPLOYMENT TESTING <br />a. Where pre -employment testing for drug and/or alcohol use is <br />required by an owner in order to perform work on their site, those <br />employees shall be tested in accordance with the owner program. <br />The Owner may have different requirements and therefore <br />employees may be required to be re -tested per the owners' <br />requirements. <br />4. RANDOM TESTING <br />a. All employees are subject to Bowen's policy to conduct <br />unscheduled random drug testing (minimum of one (1) time per <br />year or per owner requirement). Employees randomly selected <br />will be required to report for testing. Dates for random selection <br />will not be posted or announced prior to the selection. <br />b. Union employees will be subjected to the above or per the terms <br />and conditions of their union funded program. <br />C. Union employees have the right to request their on -site steward <br />be present, if available. If the steward is requested, the typically <br />two (2) hour time frame for completing the test will not be <br />hindered. This time frame shall start upon notification of test. Any <br />and all union agreement provisions will also be adhered to. <br />d. DOT covered employees will be subject to the random testing to <br />meet the current FMCSA random rates and will be in a random <br />pool that conducts random selections, at a minimum, on a <br />quarterly basis. <br />5. REASONABLE PROBABLE CAUSE TESTING <br />a. Substance testing may be implemented when there is probable <br />cause. Probable cause shall be defined as those circumstances, <br />based on objective evidence about the worker's conduct in the <br />workplace, which would cause a reasonable person to believe that <br />the worker is demonstrating signs of impairment due to alcohol or <br />drugs. The objective evidence giving rise to probable cause will be <br />observed by at least two individuals, ideally two supervisors. Prior <br />to engaging an employee for probable cause the Form 00:,3-02. <br />Reasonable, —Pro bable Case shall be completed. <br />Last Revised: May 2016 Section 3 Page 6 <br />
