13. OTHER ARE 1AREMENTS: Notwithstanding the City's responsibilities with respect to the <br />requirements listed below, the Agency agrees to comply with the following requirements, when <br />applicable: <br />A l" atr,clr ,I Pr�agN;-nin k�7�r Minorit, Business , [mmnte tlarise. The Agency agrees to comply with the <br />provisions of Executive Order 11625. <br />B. 1 „e,l,ocatrori an Agqu sifion,. The Agency agrees to comply with the provisions of the Uniform <br />Relocation Assistance and Real Property Acquisition Policies Act of 1970, (42 U.S.C. 4601), as <br />amended, and the regulations at 24 CFR 576.408, which may be amended from time to time. <br />C. E'nvno nr iept. The Agency agrees to comply with the Clean Air Act (42 U.S.C. 7401, et seq.), the <br />Federal Water Pollution Control Act (33 U.S.C. 1251, et seq.), the provisions of the National <br />Environmental Policy Act of 1969 (42 U.S.C. 4321, et seq.) and the regulations pursuant to these <br />Acts, and the environmental review responsibilities of 24 C.F.R. 576.407(d), when applicable. <br />D. f imor l ._,Preser aLi ll. The Agency agrees to comply with the National Historic Preservation Act <br />(16 U.S.C. 470 et seq.) and regulations pursuant to it. The Agency agrees to take into account the <br />effect of the project for which Community Development funding is provided under this Contract <br />on any district, site, building, structure, or object listed in or found by the Secretary of the Interior, <br />to be eligible for inclusion in the National Register of Historic Places. <br />E. A c-llrtect ut to Barriers. The Agency agrees to comply with the Architectural Barriers Act of 1968 <br />(42 U.S.C. 4151) when applicable and with handicapped access requirements of the State of Indiana <br />and the City of South Bend. <br />F. UItut al nvir urine 1,t. The Agency agrees to comply with the provisions of Executive Order 11593. <br />G. Flood Disaster. The Agency agrees to comply with the provisions of the Flood Disaster Protection <br />Act of 1973 (42 U.S.C. 4001, et seq.) and regulations pursuant to it. <br />H. 1.3;a�►ldrz�l�St��r��lards. The Agency agrees that any building for which Emergency Solutions Grant <br />Funds are used will comply with the provisions of 24 C.F.R. 576.403. <br />I 1 P c r dk.ec.lartmlg. The Agency Agrees to comply with the recordkeeping and confidentiality <br />standards detailed in 24 C.F.R. 576.500. <br />J. Use a, an 1 trlrcruuy µ9�ter. The Agency agrees to the use restrictions contained in 24 C.F.R. <br />576.102. <br />K. Home,le,ss As,s„ stance. The Agency agrees to comply with the provisions in 24 C.F.R. 576.405 <br />concerning assistance and participation of homeless individuals in the program. <br />L. Di��l<ra.e¢ ient;. The Agency agrees to minimize displacement of persons as a result of the project <br />as discussed in 24 C.F.R. 576.408. <br />M. Eligible Activities. The Agency agrees that Emergency Solutions Grant Funds will be used only <br />for eligible activities discussed in 24 C.F.R. 576.100. <br />N. i!+RcKi"ptigy Vcr°rto Ael. The Agency agrees to abide by the new requirements of the McKinney- <br />Vento Act, 42 U.S.C. § 11371 et seq. as amended by the Homeless Emergency and Rapid Transition <br />to Housing Act of 2009 (Pub. L. 111-22) (HEARTH Act), regarding the implementation of policies <br />to assist in preventing discharge of persons from publicly funded institutions or systems of care <br />from immediately resulting in homelessness. <br />
