RESOLUTION NO. 300 <br />RESOLUTION OF THE CITY OF SOUTH BEND, DEPARTMENT <br />OF REDEVELOPMENT AUTHORIZING AND DIRECTING A <br />CHANGE IN THE APPROVED URBAN RENEWAL PLAN FOR <br />PROJECT, IND. R -56 <br />WHEREAS, it is necessary and in the public interest that the <br />City of South Bend, Department of Redevelopment avail itself of the <br />financial assistance provided by Title I of the Housing Act of <br />1949, as amended, to carry out the Urban Renewal Project described <br />as the Industrial Expansion Urban Renewal Area and bounded gener- <br />ally as follows: <br />Beginning at the point of intersection of the north right - <br />of -way line of Cotter Street and the east right -of -way line <br />of Kendall Street; thence south along the east right -of -way <br />line of Kendall Street to a point 564 feet, more or less, to <br />the north right -of -way line of the New Jersey, Indiana and <br />Illinois Railroad; thence west on a line parallel to the north <br />right -of -way line of the said Railroad for a distance of <br />1,069 feet, more or less to the west right -of -way line of <br />Kemble Avenue; thence north along the west right -of -way line <br />of Kemble Avenue and its extension, for a distance of <br />330.32 feet, more or less, to the north -west right -of -way <br />line of Prairie Avenue; thence north -east for a distance of <br />265.35 feet,more or less, along the north -west right -of <br />way line of Prairie Avenue to the point of intersection of <br />the north -west right -of -way line of Prairie Avenue and the <br />extension of the north right -of -way line of Cotter Street; <br />thence east for a distance of 942.60 feet, more or less, <br />along the north right -of -way line of Cotter Street to the <br />intersection of the east right -of -way line of Kendall Street, <br />this point of intersection being the point of beginning. <br />ereinafter referred to as the "Project "; and <br />WHEREAS, an Urban Renewal Plan dated December 31; 1966 was <br />ubmitted to The Department of Housing and Urban Development and <br />ully approved by The Department of Housing and Urban Development <br />nd the Local Governing Body; and <br />WHEREAS, a Loan and Grant Contract by and between the United <br />tates of America and the City of South Bend, Department of Re- <br />evelopment was executed and dated July 31, 1968 in order to carry <br />ut said Urban Renewal Plan; and <br />WHEREAS, the Urban Renewal Plan so approved hereinafter call - <br />d "Existing Plan" contemplated the reuse and development of the <br />ntire Project Area for heavy industrial use to be developed by <br />ne developer as an expansion of existing industrial complex ad- <br />acent to the Project Area and that such development would require <br />ittle or no site improvements; and <br />WHEREAS, the contemplated redeveloper withdrew its operation <br />rom the area and from the locality thus requiring that other <br />otential redevelopers be sought; and <br />WHEREAS, a Public Offering of said Project land was made with <br />he approval of the Department of Housing and Urban Development <br />hich public offering was made subject to the installation of site <br />mprovements as required and necessitated by the redeveloper's site <br />Ian. <br />WHEREAS, the redeveloper has submitted a site plan which has <br />een approved by this Commission and which requires more extensive <br />nd different site improvements than contemplated in the "Existing <br />1 an. " <br />NOW, THEREFORE, BE IT RESOLVED by the City of South Bend <br />evelopment Commission: <br />That the Executive Director of the City of South Bend, <br />
