RESOLUTION NO. 285 <br />fTION OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT <br />:IZING THE FILING OF AN AMENDATORY APPLICATION FOR LOAN AND <br />FOR PROJECT NO. IND. R -56 <br />WHEREAS, it is necessary and in the public interest that the City of <br />South Be d, Department of Redevelopment avail itself of the financial assistance <br />provided by Title I of the Housing Act of 1949, as amended, to carry out the <br />urban reitewal project described as the Industrial Expansion Urban Renewal Area <br />and boun ed generally as follows: <br />eginning at the point of intersection of the north right -of -way <br />ine of Cotter Street and the east right -of -way line of Kendall <br />treet; thence south along the east right -of -way line of Kendall <br />treet to a point 564 feet, more or less, to the north right -of <br />ay line of the New Jersey, Indiana and Illinois Railroad; thence <br />est on a line parallel to the north right -of -way line of the said <br />.ailroad for a distance of 1069 feet, more or less to the west <br />ight -of -way line of Kemble Avenue; thence north along the west <br />ight -of -way line of Kemble Avenue and its extension, for a distance <br />f 330.32 feet, more or less, to the north -west right -of -way line of <br />rairie Avenue; thence north -east for a distance of 265.35 feet, more <br />r less, along the north -west right -of -way line of Prairie Avenue to <br />he point of intersection of the north -west right -of -way line of Prairie <br />venue and the extension of the north right -of -way line of Cotter Street; <br />hence east for a distance of 942.60 feet, more or less, along the north <br />fight -of -way line of Cotter Street to the intersection of the east right - <br />f -way line of Kendall Street, this point of intersection being the point <br />,f beginning, <br />hereinafter referred to as the "Project "; and <br />WHEREAS, it is recognized that the Federal contract for such financial <br />assistance, pursuant to said Title I, will impose certain obligations and res- <br />ponsibilities upon the Local Public Agency and will require among other things: <br />(1) the provision of local grants -in -aid; (2) a feasible method for the relocation <br />of individuals and families displaced from the project area; and (3) other local <br />obligati ns and responsibilities in connection with the undertaking and carrying <br />out of u ban renewal projects; and <br />WHEREAS, Title VI of the Civil Rights Act of 1964 and the regulations of <br />the Department of Housing and Urban Development effectuating that Title, provide <br />that no person shall, on the ground of race, color, or national origin, be excluded <br />from participation in, be denied the benefits of, or be subjected to discrimination <br />in the undertaking and carrying out of the urban renewal projects assisted under <br />Title I 4f the Housing Act of 1949, as amended; and <br />EREAS, the objectives of the Urban Renewal Plan cannot be achieved through <br />more ext nsive rehabilitation of the Project Area: <br />, THEREFORE, BE IT RESOLVED by the City of South Bend, Redevelopment Com- <br />mission: <br />1. the United States of America and the Secretary of Housing and <br />Urban Development be, and they hereby are, assured of full compliance by the City <br />of South Bend, Department of Redevelopment with regulations of the Department of <br />Housing and Urban Development effectuating Title VI of the Civil Rights Act of <br />1964 and applicable Executive Orders. <br />
