WESTERN AVENUE <br />Mr. Gilot stated an application for an Encroachment and Revocable Permit has been received for <br />the purpose of allowing the installation of channel letter signs on the front of 2518 W. Western <br />Ave., South Bend, IN 46619. The encroachment shall remain in the right of way until the time as <br />the Board of Public Works of the City of South Bend shall determine that such encroachment is <br />in any way impairing or interfering with the highway or with the free and same flow of traffic. <br />Upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the Revocable Permit <br />was approved. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE THE EAST/WEST ALLEY <br />RUNNING EAST FROM WALNUT ST. TO DEAD-END AT ANOTHER PARCEL NORTH <br />OF RAILROAD TRACKS AND SOUTH OF HURON ST. <br />Mr. Gilot indicated that Mr. Edwardo Rodriguez, 512 South Walnut St., South Bend, IN 46619, <br />has submitted a request to vacate the above referenced alley in order to combine his two (2) <br />adjacent properties. Mr. Gilot advised the Board is in receipt of favorable recommendations <br />concerning this Vacation Petition from the Area Plan Commission, Street Department, Fire <br />Department, Police Department Community Investment, and Engineering who all state the <br />request meets the criteria of I.C. 36-7-3-13. Engineering noted the alley dead -ends at an odd <br />shaped small parcel owned by a different owner and is also bordering the railroad right-of-way. <br />In addition, they stated, this alley is not technically connected to the North/South alley going up <br />to Huron Street, however people have been using these two alleys as if they were connected as a <br />legal right-of-way, when in fact, they have been driving across private property. Engineering <br />recommended that the petitioner take responsibility for re -installing a curb across the existing <br />alley approach if they are not planning to use it as a driveway. The Board stated the petitioner <br />must follow the Ordinance for hard surface material to be used if they do install a driveway. <br />Therefore, Ms. Maradik made a motion recommending approval of the request for vacation <br />
