EDDY STREET TRUNK SEWER.
<br />IMPROVEMENT RESOLUTION NO. 179.
<br />RESOLVED by the Board of Public Works of the City o f South Bend, St.
<br />Joseph County,Indiana: That it is desired and deemed necessary to construct a, sewer in
<br />Eddy St reet ,. in said city, which, from its size and character is not only intended and
<br />adapted for use by property holders whose property abuts along the line of said sewer,
<br />but is also intended and adapted for receiving sewage from collateral drains already
<br />constructed,- or which may be hereafter constructed, and the same is hereby ordered in and
<br />along the following line, in said ci.t y,t owit :
<br />Beginning at the center of the intersection of Jefferson Boulevard and
<br />Eddy Street in srAd city, thence running south along the center of said Eddy Street to
<br />the center of Diviri.on Street with a twenty four (24), inch vitrified pipe sewer; together
<br />with the h ouse connections to the curb line along the line of said improvement.
<br />And to be built in accordance with the profile, specifications,detail
<br />plans, maps and estimates now on file in the office of the Department of Public Works of
<br />said City, which include an estimate of the proportion that the cost of an adequate sew -
<br />local sewer, built along the above line bears to the cost of the main sewer; to be built
<br />as follows; The cot of an adequate local sewer, built along the above line as above
<br />described, is hereby estimated Bnd fixed to be ��� of the cost
<br />of the main sewer to be' built along said line as above set forth, which proportion as
<br />herein estimated, and fixed. shall be taken and adopted in all computations re qui ring a
<br />knowledge of the coast of such local sewer if built along the line where the main sewer
<br />is to be buiitit. The cost of the construction of said sewer shall be divided gs follows;
<br />1st. So much of such cost as shall be equivalent to the construction: of an adequate
<br />]vocal sewer not adapted to receive sewage from collateral drainp or sewers, if built
<br />along the proposed line as hereinbefore set forth, shall be paid for by the abutting pro-
<br />perty jiolders and the said city of South Bend, if it be determined that the said City is
<br />bnefited by said sewer, in the same manner .and to the same extent as local sewers .are
<br />paid for by them, under the Statute in such eases made and provided... 2nd. The excess
<br />of cost over and above what would be equivalent to the cost of a local sewer, if built
<br />along said line, shall be assessed against each piece of property In the di st ri ct or
<br />area to be drained and against the said, City, if it be determined that the said City
<br />is benefited by the said sewer, according to the manner and method presci"ibed by law:
<br />all of which said property.bene"ficially affected lies within the following described ter-
<br />ritory in the said City of South Bend , St. Joseph County, State of Indiana,towit:-
<br />Beginning on the S outh line of Jefferson Boulevard, in said City, 150
<br />feet west of the west line of Eddy Street; thence south parallel with and 150 feet west of
<br />the west line of said Eddy Street to the first alley north of Quimby Street; thence west
<br />along the said alley to the east line of Frances street; thence south along hhe east
<br />line of said Frances Street to the center line of the right of way of the Grand Trunk
<br />R.R. Company; thence easterly alo g the center line of said right of way to the center
<br />line of Greenlawn Avenue; thence north along the center line of Greenlawn Avenue to a
<br />point 200 feet south of the south line of Jefferson Boulevard; thence westerly parallel
<br />with and 200 feet south of the south line of said Jefferson Boulevard to a point 150
<br />feet east of the east line of Eddy Street; thence north parallel with and 150 feet east
<br />of the east line of Eddy Street to the South line of Jefferson Boulevard; thence west a-
<br />long the south line of said Jefferson Boulevard to the place of beginning. And each
<br />piece of property in said district or area above described, including abutting property
<br />holders and the said city of South Bend, if the said City is benefited, shall be assessed,
<br />as aforesaid, to pay said excess of cost over and above what would be equivalent to the
<br />cost .of a local sewer; all of Which will more fully appear by reference to the profile,
<br />map, drawings and specifications now on file in the oft'i.ce of t e Department of Public
<br />Works of said City, which ,among other things, gives the exact course of said proposed
<br />m-tin sewer, overflows, and its, appurtenances, and the dis: rict or area which may be in-
<br />jutiously or beneficially affected thereby, as .shown by the heavy boundary lines marked
<br />on said map and drawings, with proper words and figures written thereon, clearly indicatin,
<br />what said heavy boundary lines represent, and the di st ri ct or area embraced thereby.
<br />Assessments if deferred, are to be paid in ten equal annual installments, with interest
<br />at the rate of six per cent. per annum. A Bond or bonds shall be issued to the contracto.
<br />in payment:.t for such work, unless the property owners pay said assessments before said
<br />bond or bonds are issued. tinder no circumstances shall the city of South Bend be of be
<br />held responsible for any sum or sums due from said property owner or owners for said
<br />wok, or for the collection of the sane, or for the payment of any bond, bonds, certi-
<br />fieate or certificates issuedto said contractor in payment for such4work, except for :such
<br />moneys as shall have been actually received by. said city from the assessments for such
<br />improvement.
