4-2;4 GRADE, CURB AND SIDEWALK IMPROVEMENT RESOLUTION NO. 166. RESOLVED BY THE BOARD )F-PUBLIC 'WORKS OF THE CITY OF SOUTH BEND, ST. JB JOSEPH COUNTY, STATE OF INDT ANA,, That it i a deemed necessary to. improve TECUMSEH AVENUE FROM PARKOVASH AVENUE TO ANGELLA AVENUE by grading said Avenue from property line to p . roperty line to the established grade, and constructing cement curb:on both sides of the roadway., and the construction of cement sidewalk on the east side of said Tecumseh Avenue in accordance with the profile ,det ails.)drawings and specifications on file in the office of the Department of the Board of Public Works of said City; and such im- provement is now ordered. The cost of said improvement including the cost of street and alley intersections, shall be assessed upon the real estate abutting on said TECUMSEH AVENUE FROM PARKOVASH AVENUE TO kNGELLA AVENUE UNDER IMPROVEMENT RESOLUTION 9 No. 166. all according to the method and manner provided for in Act of the General As- semblY of the State of Indiana.entitled "-An Act Concerning Municipal Corporations,," ap approved:March 6,1905 and in accordance with and pursuant to the provisions of all 1 a- mendabory and supplemental acts thereto, passed by, the General Assembly of the State if of Indiana. Assessments i,f def6rred,, are to be paid in ten -equal annual installments with interest- at the rate of :Six per cent per annum. 'A Bond or bonds shall be issued to the -contractor in payment of such work unl ess the property I erty owners, pay, said assess- ment before said bond or bonds are issued. Under no circumstances shall the City of South Ben4 be,, or be held responsible for any sum or sums due from,said property ovine or owners for' said work for the collection of the same, or for the payment of any bond bonds,, certificate or. certificates, issued to - said contractor in payment, for such work except- for su-oh moneys as shall have been actually received by the City from the ass- essments for such improvement, or such` moneys as said City is by said above entitled Act required to pay. This Board will give a., hearing on this resoluti on in its office in the City' Hall, on the. 31st. day, of May 1912 at 10:00 A.M. Adopted this lst. day of May 1912. Motion made, seconded and carried that the foregoing" resoluti on be unanimously adopted - VACATION'RESOLUTION NO. 17- RESOLVED BY THE BOARD OF PUBLIC 'WORKS OF THE CITY OF'SOUTH BEND, INDIANA: That it is desirable to vacate the First. Alley North of Liston street from the West line of Birdsell Street to thb First North and South Alley West of said ,BirdsellbStre.et in the City of South Bend, County of St. Joseph and state of Indiana which alley proposed to be vacated is more specifically described as.follow's:- Beginning on the west line of Birdsell Street,. and the south line of the, Fi rst alley north of Liston Street; thence West along �..the south line of said alley_ 115.5` f6et�'to the east line of the first alley westV.of Birdsell Street; thence North 12454 feet to the North line of alley; thence East 11505 feet to the West line of Birdsoll Street; thence South 12.54 feet to the place of beginning.) all, as shown by a plat of sU-eh"proposed vacation now on file- in the office of the department of Public Works of said City. The property which may be injuriously, or benefically. affected in the; City of South Bend, St-. Fuzy. Notice of this Resolution shall be published on the 4th. day of May and on the llth* day of May 1912 in the South Bend Daily Times. This Board at its office in the City Hall on the 29th. day of May 1912 at 10:00 A.M. will hear and receive remonstrances from all persons interested in or affected by these proceedings.
