CURB AND SIDEWALK IMPFO VEMENT RESOLUTION NO. 156. I RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND ST. JOSEBH ,COUNTY, STATE OF INDIANA, That it is deemed necessary to improve.,Emerick Atreet rrom ,Washington Avenue to Jefferson Boulevard, by removing the old Brick vwalk where they 'are not in gopd condition and constructing- cement sidewalk and cement curb where nee -dssary, ix aeeordanee -.with the profile, details. , drawings and rpeeifiaations an, file -in the offi ce of the, bepartment of the Board of Publi c Works of said City ; and such •iliprovemeiit is now ordered. The -cost of .said improvement, including the cost of street, and alley inteir •sections shall be assessed upon. the real estate, abutting on said EMERICK STREET FROM. 4WASHINGTON AVENUE TO JEFFERSON BOULEVARD.: all according to the mmethod' and manner ;pro'- ~vided for in Act of the >General Assembly of the State of Indiana, entitled " An Act ,.-Concerning, Muni eipal Corporations ,.approved March 6, 1905, and in accordance with and pursuant to,the provisions -of, amendatory and supplemental acts tleret®,pa,ssed by the General Assembly of the State of Indiana. - Assessment s,if, defferred ,are to b Abe ;paid in ten equal annual installments with interest at the rate of Six per cent pe Tper annum. A Bond or bonds shall be issued to the contractor in'payment of such work 'unless the property owners pay said assessment before said Bond or bands are issued. Under no circumstances shall the City_ of South Bend,be;or 'be held responsible . for any sum or �cums due from said property owner or 'owners for said work or for the- collectin -of the came,. or for the payment., of any bond, bonds, certificate or certicates, iesuet% -to said contractor in payment for such '"cork, exePpt for Fueh moneys as shall;have' ,ben, been actually received by the City from -the assessments for such improvement, or such .-moneys as Said City is by said --above entitled Act required to pay. All proceedings had, and work done ix_ the making` of said improvement, assessment of property, col ieetion of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act and amendments thereto. RESOLVED' BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,CDUNTY OF ST. .JOSEPH, STATE OF INDIANA, That the" construction of a local sewer, intended and adapted,only for local use by the -property holders whose property abuts thereon, and not intended; or adapted for receiving sewerage from collateral drains, be anal -thesar same is,hereby ordered in and -along Studebaker Street from Fassnacht Avenue to Linden Avenue, vi 2: - Begirining at the center of F+'assnacht Avenue and Studebaker Street.; thence south along the center line of said Studebaker Street to a point about I0(i feet north •o_f the north line of Linden. Avenue with a 12 inch vitrified pipe sewer, together with the nessgsary mmanholes,inlets and i-.ouse conn.ection.s to the curb line along-thc-lin,e d of said ir;-provement, and said sewer, with all its appurtenances shal.l'"be constructedfi in aecordiance with the profile and opecificatioks now on file in the office -of the Department of Public Works of said City. The cost of said improvement shall bt `app" tioned against and paid by the property holders whose property abuts thereon, and up- •ox the City of South Bend if the City is benefited by said improvement, all'acd®rd- ing to the method and manner provided for in Act of the -General Assembly of the Stab of Indiana, entitled "An Act Concerning Municipal Corporation;" approved March- 6, 1905. Assessment s,if.deferred, are to be paid in ten. equal annual installments, with interest at the rate of. six per cent per annum. - A bored or bonds shall Ue issued -to the contractor is pay+,ent for sueh work,un.less the property owners- pay said Assess- ments ;before said bond or bonds are issued. Under no circumstances shall the City of South Bend be or be held responsible for any sum or sums due from said .property N, owner or owners for said work, or.for the collection of same,or for thepayment of any . bond or bonds certificate or certificates,issued to said contractor in payment for sh such work,exeept -for such moneys as shall have been actually received by the City from the assessments for sueh improvement, or such moneys as said City is by said above entitled Act required to pay.
