Referred to the 'City Engineer for investigatin <br />- CURB AND SIDEWALK IMPROVEMENT RESOLUTION NO. 153. <br />✓ RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,ST. JOSEPH <br />COUNTYIST'ATE OF INDAIAN, That it in deemed necessary to improve Howard Street from <br />Notre Dame Avenue to Eddy Street by the cunct ruction of cement sidewalks and cemet <br />curb on both sides on said Howard Street in accordance with+he'profile ,d.etails, <br />drawings and specifieations on file in the office of the Department of the EBoardd' <br />of Public Works of said City; and such improvement is now ordered. The cost of <br />said imp rovement,including the cost of street and alley intersections, shall be <br />assessed upon the real estate abutting on said Howard Street from Notre Dame Ave. <br />to Eddy Street, all according; to .the method and manner provided for in Act of the <br />General Assembly of the State of In.dian&, entitled "An Act Concerning Municipal <br />Corporaationat," approved March 6,1905, and in accordance with and pursuant to the <br />provisions of all amendatory and supplemental acts thereto,passed by the General <br />Assembly of the State of Indiana. Assessments,1f deferred, are to be °laid in ten <br />equal annual ixetallments, with interest at the rate of Six per cent per annum. <br />A Bond or bonds shall be i -sued to the. contractor in payment of such work,unless <br />the property owners pay said assessment before said bond or bonds are issued. <br />Under no circumstances shall the City of South Bend,be, or be held responsible <br />for any sum or sums, due from said property owner or owners for said work or for <br />the collection of the same, or for the payment of any bond,br •bonds, certificate <br />or certificates issued to said contractor in payment for such work,exeept for <br />,such moneys as .shall have been actually received by the City from the assessments <br />for such improvement,or such moneys as said City is by said above entitled Act <br />required to .pay. All proceedings had, and work done in the making of said im- <br />p.rovem.ent,assessment of property,collectioxof assessments and issuance of bonds <br />therefor,shall be as psrovided for in said above entitled Act and amendment thereto <br />Notice of this resolution shall be published on the 3rd. day of May 1912 and <br />on the 10th. day of May 19129in the South Bend Daily Times.
