IMPROVEMENT RESOLUTION NO. 161. <br />MICHI GAN., STREET TRUNK SEWER, <br />RESOLVED, BY the Board of Public Works of the City of South Bern d.St. <br />Joseph CountylIndiana, that it is desired and deemed, necessary- to construct a sewer in <br />Michigan Street and. LaSalle Avenue, said cit y.,whi ch, from its size and character is not onl <br />intended and adapted for use by property owners whose property abuts, along the dine of saig <br />sewer but is also -intended and adapted r foreceiving sewage from collateral drains already <br />constructed or, which maybe hereafter'. constructed., and the same is hereby ordered construct- <br />ed 4h.%and along Michigan Street and LaSalle Avenue, beginning at a point -in the center of <br />LaSalle Avenue where the same* intersects with the westerly bank of the St. Joseph Riverin <br />the said City ofSouthBend; thence running west along said LaSalle Avenue. to Michigan <br />Street with a sewer sixty, (60) inches in diametei; thence south along Michigan Street to the <br />center of Washington Avenue with <br />h a sewer sixty (60) inches in diameter; thence still south <br />along Michigan -Street to the center of Jeffe rson Youlevard with a sewe.r, fifty-four- (54) <br />inches in� diameter; thence still south along Michigan Street to Division Street, with a sewer <br />forty-eight (.48) inches in diameter, together with all the necessary house and store cm- <br />nections to the curb line along the whole length, of said improvement,, and to be built in <br />accordance with the profile, specificationsdet ail plans ,maps and estimates now on- file in <br />the office of the"Departmentof Public Works of said City,, which includes an estimate of the <br />proportion thiit the cost of an adequate local sewer, built along the above line, bears to <br />the cost of the main sewerto-be built as follows: The cost of an adequate local sewer.buill <br />along. the line above describedis hereby estimated and fixed to be <br />of the cost of the main sewer to be built along said line as above set forth2which propor- <br />tion, as herein estimated and fixed, hhall be to en and adopted in all computations requir- <br />ing a knowledge of the cost of such local sewer if built along the line where the main sewer <br />is to be built. The cost of the construction of said sewer shall be divided as follows: <br />1..So much of such cost as shall be equivalent to the construction of an <br />adequate local sewer not adapted to receive 'sewage from, collateral -drains I or sewers, if <br />built along the proposed line as hereinabove set forth.shall be paid by the abutting pro- <br />perty holders and the said City of South Bend., if it be I determined that the said City.is <br />benefited by said sewer in the same manner and to the same extent as local sewers, are paid <br />.for by them, under the Statutes in such cases made and provided. <br />20 The excess of cost over and above what would be equivalent to the cost of <br />a local sewer, if built along said line, shall be assessed against each piece of property <br />.in the district or area to be drained and against the City, if it be determined that the <br />.9aid City is benefited by the said sewer,, according to the manner and method prescribed by <br />law, all of vhich said property beneficially affected lies within the following described <br />territory in the City of South Bend, County of St. Joseph, and State* of Indiana,,to-wit:- <br />Beginning at the center of LaSalle Avenue and the first alley west of <br />Michigan Street,, in the said City of South Bend; thence south along the center line of said <br />alley and said alley produced and extended, to the center of Ewing Avenue; thence east a- <br />long the center of Ewing Avenue to the first alley east of Michigan Street; thence north <br />along the first alley east of Michigan Street to the first alley south of Calvert Street; <br />thence east along said alley to the center of Witwer Avenue; thence north along the center <br />of Witwer Avenue to the first alley south of Dubaifivenue; thence east along said alley <br />to the center of Carroll Street; thence north along the center of Carroll Street to the <br />Alley south of Pennsylvania Avenue; thence west along said alley to the center of Witwer <br />Avenue; thence north along Witwer Avenue, and through the alley between lots eighty-three <br />(93) and Eighty-four (94) Elder Place Addition, to the first alley north of :Pennsylvania <br />Avenue; thence east along said alley to the first alley west of Carroll Street, thence north <br />along t e center of the first alley west of Carroll Street to a point one hundred fifty <br />(150) feet south of the south line of Sample Street; thence west parallel and one hundred fi <br />fifty(150) feet south of the south line of Sampiq Street to a point one hundred sixty-five <br />(165) ' feet east of the east line of Michigan Street; thence north parallel with and one <br />hundred sixty-five (165) feet east of the east line of Michigan Street to a point one hundre <br />fifty (150) feet south of the southt.1ine of Tutt Street; thence east parallel with and <br />one hundred fifty (' 150) feet mouth of the south line of said Tutt Street to the Southerly - <br />line of the Lake Shore and Michigan Southern Railway Company's right of way; thence north. <br />across lot Twenty -nin�29) Denniston and Fellow's Addition to the north and South alley <br />between Columbia Street and Fellows Street; thence still north following the center line of <br />said alley and said alley produced to Mohroe Street; thence east along the center of <br />Monroe Street to a point One hundred (100) feet east of the east line of Columbia Street <br />to the center of Division Street) thence east along the center of said Division Street to <br />Vistula Avenue; thence west along the center of Washington Avenue to a point one Hundred <br />sixty-five (165) feet east of the east line of Michigan Street ; thence north parallel with- <br />andv6ne hundred sixty five (165) feet east of the east, line of Michigan Street to the <br />wester n bank of the St. Joseph River,, thence northwtsterly following the westerly bank of <br />the St. Joseph River to a point one hundred sixty five (165) feet north of the Korth line <br />of LaSalle Avenue to the first alley west of Michigan Street; then c- h slazig s ai d <br />
