<br />RESOLUTION NO. 276
<br />RESOLUTION RELATING TO ACQUISITION OF PROPERTY
<br />BY CONDEMNATION, IND. R -57, LASALLE PARK
<br />W EREAS, it is necessary by the Board of Commissioners of the Depart-
<br />ment o Redevelopment of the City of South Bend, Indiana, to acquire the
<br />follow'ng real estate in the urban renewal area known as Ind. R -57 - LaSalle
<br />Park P oject, in the City of South Bend, Indiana:
<br />W EREAS, the Department of Redevelopment of the City of South Bend,
<br />Indiana, has made an effort to purchase the above- described property from
<br />the ow ers, but the Department and said owners have been unable to agree
<br />as to the purchase price, or the preliminary title examination has the
<br />proper y to be owned by the county auditor, or greatly encumbered.
<br />B17 IT RESOLVED, that the Executive Director cause a notice and final
<br />offer n writing to be made to each of the above owners at the respective
<br />concur d -in price, which final offer shall include an invitation to discuss
<br />the ac uisition of owner's property with the Department of Redevelopment
<br />within ten (10) days from mailing and a notification that Eminent Domain
<br />procee ings will be instituted immediately after said ten (10) day period
<br />if agr ement cannot be reached on the purchase price within said ten (10)
<br />days.
<br />B IT FURTHER RESOLVED, by the Commissioners of the Department of
<br />Redeve opment of the City of South Bend, Indiana, that in the event an
<br />agreem nt cannot be reached on the purchase of the property within ten (10)
<br />days a ter notice of final offer, then the Commissioners do hereby deter-
<br />mine t at they shall proceed to acquire the above- described parcels of real
<br />estate under the power of Eminent Domain as described by the laws of the
<br />State f Indiana in order to carry out the redevelopment plan, and their
<br />attorn y, Bruce C. Hammerschmidt, is directed to file a complaint after
<br />said t n (10) day period in the name of the City of South Bend, Indiana,
<br />on beh if of the Department of Redevelopment in the appropriate Court of
<br />St. Jo eph County, Indiana, in order that an appraiser be appointed to
<br />establ sh the value of said real estate.
