REGULAR MEETING <br />JANUARY 8, 2007 <br />Mr. Nemeth advised that the petitioner is requesting a zone change from LI Light <br />Industrial District to CB Community Business District to allow a restaurant, financial, <br />hospitality, and other retail uses. The site is vacant land with half a retention pond zoned <br />LI Light Industrial District. To the north is property with half of a retention pond and the <br />Woodwind distribution/storagebui1ding. To the east is a freight business zoned LI light <br />Industrial District. To the south is vacant land zoned CB Community Business District. <br />To the west is the U.S. 31 Bypass. The CB Community Business District is established <br />to provide a location for high volume and high intensity commercial uses. Activities in <br />this district are often large space users which may include limited amounts of outdoor <br />sales or outdoor operations. The rezoning is approximately 3.18 acres of a larger 6.18 <br />acre development project. The rezoning site plan shows a one story 9,000 square foot <br />commercial building covering approximately 7% of the 3.18 acre site. The northern <br />portion of the site consists of half of a retention pond. The rezoning site will have two <br />curb cuts on Ameritech Drive. Approximately 50 of the development's parking spaces <br />are provided on this rezoning site. Type A Open Landscaping (one deciduous tree every <br />40 feet) will be required along the western property line. Foundation landscaping will be <br />required on the northern, eastern, and southern building facades. This subdivision, U.S. <br />31 Industrial Park -Section 1, was granted secondary approval on October 23,1997. <br />The trend in the area is development ofoffice-warehouse and highway commercial uses. <br />Ameritech Drive has two lanes. Brick Road has four lanes. The site will be served by <br />public water and sewer from the City of South Bend. The rezoning is consistent with the <br />Comprehensive Plans land use policy. The site is vacant land. The area is commercial <br />and industrial in character. The most desirable use for this property is commercial and <br />industrial. The surrounding property values should be conserved with the CB <br />Community Business District zoning. It is responsible development and growth to allow <br />vacant property to be used as part of a larger development project. Based on information <br />available prior to the public hearing, the staff recommends that the petition be sent to the <br />Common Council with a favorable recommendation. <br />Mr. Christian J. Davey, 3930 Edison Lakes Pkwy., Ste 200, Mishawaka, Indiana, made <br />the presentation for this bill. <br />Mr. Davey advised that PCN, LLC is requesting that this property be rezoned from LI <br />(Light Industrial) to CB (Community Business). This rezoning is requested to allow for a <br />restaurant, financial, hospitality, and other retail uses. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember, Dieter made a motion for favorable <br />recommendation to full Council concerning this bill as substituted.
