RESOLUTION NO. 236 <br />RESOLUTION AUTHORIZING THE ACCEPTANCE OF BID OF <br />WARREN OUTLAW FOR LAND IN THE LASALLE PARK PROJECT, <br />IND. R-57 <br />WHEREAS, the South Bend Redevelopment Commission accepted bids <br />by public offering on April 11, 1968, for sale of land within the <br />LaSalle Park Project and that Place and Company, Incorporated, 1920 <br />Ridge ale Road, South Bend, Indiana, bid for Parcel #18-10 was <br />accep ed as being the highest acceptable bid; and <br />WHEREAS, the South Bend Redevelopment Commission has received <br />a petition in writing from Place and Company, dated September 20, <br />1968, requesting that their bid for the above named parcel of land <br />be withdrawn and that they be relieved of all responsibility for the <br />development thereof; and <br />HEREAS, the South Bend Redevelopment Commission received at the <br />afore aid mentioned public offering the bid of Warren Outlaw for <br />Dispo ition Parcel #17-19 in the amount of $898.00; and <br />WHEREAS, Mr. Warren Outlaw upon commencing construction upon <br />said of made an excavation for the basement of a residential structure <br />and found unsuitable soil conditions and thereupon petitioned the South <br />Bend edevelopment Commission for relief from the purchase of Parcel <br />#17-19 as being an unbuildable site, and further requests a refund of <br />the pqrchase price on Parcel #17-19 and that he be permitted to pur- <br />chaselDisposition Parcel #18-10; and <br />HEREAS, the South Bend Redevelopment Commission after having <br />made oil tests and analyses thereof now determines that Disposition <br />Parce #17-19 is in its present condition an unbuildable residential <br />site ; and <br />NOW, THEREFORE BE IT RESOLVED THAT, the South Bend Redevelopment <br />Commission approves the withdrawel of the bid of Place and Company <br />for Parcel #18-10 and hereby further relieves Place and Company of all <br />resporisibility from the purchase and development of said parcel under <br />the Urban Renewal Plan; and <br />author <br />#17-1� <br />yeas oz <br />a s imi <br />Warren <br />E IT FURTHER RESOLVED THAT, the South Bend Redevelopment Commission <br />izes and directs that the purchase price for Disposition Parcel <br />be refunded to Warren Outlaw in the amount of $898.00 for the <br />said parcel in its present condition is unbuildable, subject to <br />ltaneous reconveyance of said parcel by Quit-Claim Deed from <br />Outlaw and his wife to the Department of Redevelopment. <br />
