The same was ref ered to the, City Engineer. v Petitlont;_1received and referred to the City Engineer. asking that €6 grade -be established, on South'Main Street from Jay Street South.. Resolved by the BOARD of PUBLIC WORKS of the CITY of SOUTH BEND, yINDIANA. That }permission is hereby grhhte(' the Indiana & laic igan Eectric Coompany"�;tonbo.nbt mbtgti . iiti%p.,�.andn-ldisbharge�'pppeline in Colfax Avenue from .the east bank of the St. Joseph River to said Company's Power --house, which is located at the north east corner of Bridge Street and Colfax Avenue, said permission shall be subject to t e following conditions. Frist:- The location of said intake and discharge pipes shall be along lines .to be established by the City Civil Engineer. Second: The Indiana &11 Michigan Electric Company shall at their expense ,fconastruct a new concrete wing wall and protect the abutment at the south east corner of the Colfax Avenue bridge. Third : - The Indiana & Michigan Electric Company shall construct a 10" vitrified pipe sewer from the St. Joseph River to the west line of lot 6 in Mack's Sub -Division for t e benefit of the City and abutting property owners. The line and grade to be iven by the City Engineer. +ourth: - T. he Indiana & Michigan Company shall relay in a satisfactory manner all pavement, cement side -walk and curbing taken pp and shall file a bond in the sum of $ 1,000.00 good for a period of one year from the completion of said., work, to guarantee the repaving and repairing of any defective work', which may develop Within such specified time. Fifth: - All of the above shall be done at the risk of tie said Indiana & Michigan Electric Corcpany, and they shall assume the responsibility and risk of damages to the work or to the property on line of said wohk which results from floods, backwater, caving of street, settling of foundation of bridge or other causes whatsoever connected with the construction of said work. Sixth: - The Board of Public Works reserves the right to appoint an In6pect6mr, who shall be on the work during the construction of tie wigng wall and relaying of the pavement, sidewalks and. curbing to see that said ,,:: w6kkis constructed in a proper manner. The Indiana & Michigan Electric Compay shah. pay to the City of South Bend, the sum of 03.00 per day for each day said Inspector is required. Said Inspector shall be under the direction b of the City Engineer who shall have power to stop the work, if same is not „being properly done, or if the material beng used is not of approved. quality or fnr any other good and sufficient cause. Seventh:- ', The time of competion of this work shall be 60 days from the date of tethe starting. The time of completion is an essential element and tree sum of $50.00 per day shall be paid the City of South Bend, for every day, over the 6.0 day that the street is closed to traffic, which sum it is agreed is the ;iquidated damages which the said City will sustain eahh day by reason of such delay. Ei ghth: - All the work of replacing the pavement, walks, curbing andcon- pongtructing of wing wall shall be under the supervision of the City Engineer acting under the direction of the Board of Public Works, and all work shall be ,according to the plans and specifications on File in the office of said . Engineer.
