Staff Report 6/12/2019 <br /> Agency Comments: <br /> Commitments: <br /> The petitioner is not proposing any written commitments. <br /> Criteria to be considered in reviewing rezoning requests,per IC 36-7-4-603: <br /> 1. Comprehensive Plan: <br /> Policy Plan: <br /> This petition is consistent with City Plan, South Bend Comprehensive Plan(2006), <br /> Objective H 1: Ensure that an adequate supply of housing is available to meet the needs, <br /> preferences, and financial capabilities of households now and in the future; and Objective <br /> ED 7: Support neighborhood-based economic development. <br /> Land Use Plan: <br /> The Future Land Use Plan identifies the site for commercial uses. <br /> Plan Implementation/Other Plans: <br /> The site is located within the boundaries of the River Park Neighborhood Preservation <br /> Plan(1997),but there is no specific mention of the property in the plan. The plan calls for <br /> the overall beautification of the Mishawaka Avenue Corridor. <br /> 2. Current Conditions and Character: <br /> Mishawaka Avenue features a mix of residential and neighborhood-based businesses that <br /> addresses the needs of the surrounding community. <br /> 3. Most Desirable Use: <br /> The most desirable use for the property is residential or mixed-use that is compatible with <br /> the surrounding properties. <br /> 4. Conservation of Property Values: <br /> Locating a residential use should not adversely affect the property values of the adjacent <br /> properties. Any potential commercial development in the future will need to meet the <br /> appropriate development standards and is consistent with the Mishawaka Avenue Corridor. <br /> 5. Responsible Development And Growth: <br /> It is responsible development and growth to zone for mixed-use development along a <br /> historically mixed-use corridor. <br /> Staff Comments: <br /> The staff has no additional comments at this time. <br /> Recommendation: <br /> Based on information available prior to the public hearing, the staff recommends sending <br /> this variance to the Common Council with a favorable recommendation. <br /> Analysis: <br /> Rezoning this site to MU Mixed Use District is consistent with the Mishawaka Avenue <br /> Corridor and will allow for residential development consistent with the neighboring <br /> properties. <br /> APC# 2896-19 Page 2 of 3 <br />
