<br />In our jud ement the White Construction Co. is in no wise responsible
<br />for the present condition of the pavement in question. The condition of'this..
<br />avemsnt is common with the condition of man pavements thruout the country and
<br />:Ano at this time maim to the high penetration, as, determined by your Uemist
<br />m- d the long eriod of extemely hot weather experienced this'su.rumer9 coupled
<br />With the grea increase in the number and weight of motor riven vehicles and
<br />-the absence o any.propeetion of the street against extremely heavy or narrow
<br />tired conveyances.
<br />Nottithstandin. the fact that we are not liable For °the condition of
<br />the street in question, and because we reel, just as you do, that it is unfortunat
<br />.are hard to explain to the layment that such a condition should exist, we propose
<br />at a veasonable time.to make extensive repairs to the street, in an, :.effo.rtq,;;to
<br />correct these conditions, altho they -have. not arisen thru,any faulty_ construction
<br />oIr materials or, other fault of ours.
<br />As you know, and as any one familiar<wiih the: nature of-aspha7:t
<br />pavements know- it would be Poll to make any repairs to this street at this time.
<br />If -the repairs were made now, ang we should get.another,.siege of warm weather,
<br />the pavement would rut up in the same manner as it.is at present. On the other
<br />hand,- as soots" as the weather cools, the trafff8 will iron out mast, of the , present
<br />ruts. We propose to wait until October 1st.1 when the'warm weather wll be over,
<br />and'then make a thoro investigation of the street in conjunction with your re-
<br />presentatives acid at that time determine just what repairs should be made .
<br />We trust that this will meet with the approval of your Honorable
<br />Body.
