Dutcher 18.00 <br />The following remonstrance filed. <br />TO THE HONORABLE MAIM OF PUBLIC IYORKSL .OF THE, CITY OF <br />SOUTH BEND. <br />IN THE MATTER OF THE CONDEMNATION RESOLUTION <br />NUMBERED SIXTY- ONE FOR THE OPENING OF A STREET <br />FROM SAMPLE STREET SOUTH ON THE WEST ONE -EIGHTH <br />SECTION LINE OF SECTIONS FIFTEEN AND TWENTY -TWO <br />IN TOWNSHIP THIRTY-SEVEN NORTH,:RANGE TWO EAST <br />SOUTH BEND, INDIANA TO PRAIRIE AVENUE <br />owners whose Th Gr d ru West rg Rallwat Compa y ne of th roperty <br />proper yy s# 1 �e affecte� by the opening¢ op saia proposed Street, <br />respectfully remonstrates -against said proposed action on each of the following <br />grounds: <br />commonly known al`tw#ah &�4 k0aos8f i� a e�I�n �ya� l�fi ° o '$ -TAM s <br />_ <br />this remonstrant, including two main tracks and three -switch or storage or <br />a pssing tracks and will also cross the tracks of the New Jersey Indiana and Illinoe <br />Railway Company and four tracks of the New York Central Railroad Company and will <br />render said Oliver Yards of his remonstrant practically useless for the purpose <br />for which they are intended and therefore amount to the taking and will be a taking <br />qdf the property of this remonstrant without compensation which property is already, <br />evoted to a public use, namely; that of transportation for hire by railroads in <br />both inter and intre state commerce. - <br />2. That the lands and property of this remonstrant will be damaged <br />by the op gg ing of sa d proposed street or hi hwa in the sum of Thirty-five <br />Thousand [ 35,000.00 Dollars, while there w 11 be no benefits to the lands of this <br />remonstrant.. <br />3. That the damages that will be caused by the opening of said <br />proposed street or highway will exceed the benefits therefrom. <br />4. That the property at the North end of said proposed street is <br />platted andthat said proosed street or highway would not connect at either the <br />north of south end thereofwith any other North -and South Street and as it is now <br />proposed to ppen the same there would be a ,,jjo at the North end to the West to <br />Anthony Street or to the East one-half block o Kaley Street, <br />6. That no petition has been filed with the public service ,con - <br />mission of Indiana asking that said proposed highway be opened and there has- been <br />no order of said commission directing or permitting the opening of said street <br />or ,highway. <br />,6.. That the Board .of Public Works of the City of , South Bend, <br />Indiana, does ,nat.haae.authority.or jurisdiction to open said highway or street. <br />17.
