Resolved °by the Board of Public Works of the City of South Bends St. Joseph County, State of Indiana, That it is deemed necessary"to improve Dayton Street from Miami Street to the first, alley° !,vest of Marine Street as follows, to -wit:- oe Said street shall be grAded from property line tp° rflp � y line to the established grads, cement curb and cement sidewe,lk sb.e.11°be cons ruc e on both sides of said street where same is necessary and not already constructed, all as is more particularly s}aown and all in accordance with the plans, profiles detail draw-. i s a d g e ifie&t io s n file in the Office of the Department of Public Works &f tb t9 CNy a gouth Ben , ?ndan&* The cost of said improvement, including thw cost of Street and alley intersections, shall be assessed upon the'real estatQ abutting* on said Da ytcin Street all according to the method and manner'pvadiect for in an Act of the General Assembly of the State'of Indiana, entitled " An Act Concerning Municipai Crporations, approved Larch 6,1905., and in accordance with and pursuant to the provisi®ns of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assements, id ferred are to be paid in ten equal annual installments with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment of such work, unless the property owners pay,said xxx said -assessment before.said.bind or bonds are issued: Under no circumstances shall the City of South Bend,,be, or be held responsible for any sum or sums due from E, said property owner or woenrs for said work or for the collection of the same', or for. the payment of any bond bonds,certificate or certificatesm issued to said contracts in'.payment for such work, except for such moneys as shall have been actually recefired by the City from the assessments for such improvement, orsuch moneys as said City is. by said above entitled Act rwqu.ired to pay, All proceedings had and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bands, therefor , shall be as provided for in said above eneitlted o Act and amendments thereto: Notice,of this resolution shall be published on the 15th. day of April 1921 and on the 22nd. day of April-1921 in the South Bend Daily Tribune.
