The widening of said Ewing Avenue will interfere with the tracks aid <br />side. tracks and switch tr ckp of this xemonstra t in that the points of the switch of <br />what is commonl��rr called t o Mary Ann track or this remonstrant north of the present <br />Ewin Avenue wi11 be thrown ,into s id Ewing Avenue if widened as contemplated and rewqire <br />the om lete alteration., change and ag of the 'tracks' of this remonstrant in its <br />South Bend Yards, at an expense oi'' 25 060 �0, and will reader said tracks and yards <br />d�a Brous to ,its empp�leyyes and those riding thareou, all to the damage of this remonstrant <br />in f he sum of $25,000.00. <br />3rd The wideninj of EwingAvenue as propo d will throw the switches <br />and switch tracks. of this affi n into .r xg Avenue and wi require the reconstruction, re- <br />laying and remov i there 6f and will therebyre uire the. removal nd re lacin of its <br />presexxt existing track alon and used by thInternational India �ubberpCorpo ation . and <br />result in the curtailment of the-shippiag facilities of said International India, Rubber <br />Corporation by depriving it if the service of a partpof its present track facility, <br />4th. That there is no n cessity of public need for the widening of Ewing <br />Avenue <br />5th. That the lands of this remonstrant are assessed no damages whilelands. <br />East of this remonstrant owned by the International India Rubber Corporation, are awarded <br />1440.58 damages, and lands of the International India: Rubber Corporation West of this <br />k emonmraut are awarded 442 95 damn es; the land of Mabel Lee Matthews is awarded <br />1 556.00 damages and he dot o A to J.
