<br />WHEREAS. the C ity of South Bend, Ind iena, by and through its
<br />Board of Public Warks, heretofore, by improvement resolution No. 752 caused South
<br />Michigan Street, from Ewing Avenue. to a point forty feet (401) north of Fairview
<br />Street, now in the City of South Bend, Indiana, to be improved by paving the same] and,
<br />WHEREAS, the Chicago, South Bend & Northern Indiana Railway Company
<br />Occupies & portion of said street for the operation of its electric railway, and by
<br />the terms and conditions of its franchise is required to pave a portion of said street;
<br />and,
<br />WHEREA89 the portion of said street required to be paved by said
<br />Railway Company was paved by the White construction Co., as contractor for
<br />such work, and same was completed by it as such contractor bald accepted by the ' City
<br />of South Bend, Indiana, on Nov
<br />eleber 17,1920; and,
<br />WHEREAS, the said Railway Company on the 22nd. day of November 1920,
<br />'executed and filed with the said City of South Bend, Indiana, its sttpulatIon and
<br />-agreement waiving objections on ace unt of any illegality or irregularity in 'the
<br />proceddinga had for such improvement of said street and requested the City to issue
<br />bonds .to pro-oure funds ig1th which to pay that portion of the cost of said improvement
<br />chargeable against said Railway Company in the manner provided by an Act entitled
<br />" An Act Concerning Municipal Corporations, "approved March 6,1905; and all amendatory
<br />and supplemental acts thereto; and,
<br />f WHEREAS, it appears that the amount Chargeable to andpayable
<br />by said Railway Company by reason of said improvement amounts to the total sum of
<br />Five thousand three hundred ninety three and 73/100 5
