RESOLUTION NO. 175 <br />RESOLUTION RELATING TO ACQUISITION OF PROPERTY <br />BY CONDEMNATION IND. R -57, LASALLE PARK <br />WHEREAS, it is necessary by the.Board of Commissioners of the <br />Department of Redevelopment of the City of South Bend, Indiana <br />to acquire the following real estate in the urban renewal area <br />known as Ind. R -57 - LaSalle Park Project Area in the City of <br />South Bend, Indiana: <br />Owner Concurred -In <br />Acquisition Price <br />33 -13 <br />Essie A. Lewis <br />$ 5,220 <br />38 -10 <br />George H. Morgan <br />510 <br />38 -11 <br />County Auditor <br />505 <br />39 -15 <br />Samuel Penegar (Estate) <br />1,070 <br />39 -16 <br />James J. Cauffman (Estate) <br />510 <br />42 -10 <br />County;Auditor (McDonald) <br />1,495 <br />WHEREAS, the Department of Redevelopment of the City of South Bend, <br />Indiana has made an effort to purchase the above described property <br />from the owners, but the Department and said owners have been unable <br />to agree as to the purehase price, or the preliminary title examination; <br />has s own the property to be owned by the county auditor, or greatly <br />encum4ered, <br />BE IT RESOLVED.,that the Executive Director cause a notice and final <br />offer in writing to be made to each of the above-owners at the respec- <br />tive cqnCurredwin price, which final offer shall include an invitation <br />to discies. the acquisition of owner's property with the Department of <br />Redevelopment within 10 days from mailing and a notification that <br />Emine t Domain proceedings will be instituted immediately after said <br />10 da5 period if agreement cannot be reached on the purchase price <br />withir said 10 days. <br />BE IT FURTHER RE$DLVED by the Commissioners of the Department of Rede- <br />velopment of the City of South Bend, Indiana, that in the event an agree- <br />ment cannot be reached on the purchase of the property within 10 days <br />after notice of final offer, then the Commissioners do hereby determine <br />that they shall proceed to acquire the above described parcels of real <br />estate under the power of Eminent Domain as described by the laws of <br />the State of Indiana in order to carry out the redevelopment plan, and <br />their attorney, Brute C. Hammersehmidt, is directed to file a complaint <br />after said 10 day period in the name of the City of South Bend, Indiana <br />on be if of the Department, of Redevelopment in the appropriate Court <br />of St. Joseph County, Indiana in order that an appraiser be appointed to <br />estab ish the value of said real estate. <br />this 4th day of May, 1967. <br />ATTEST: <br />CITY OF SOUTH BEND <br />DEPARTMENT OF REDEVELOPMENT <br />By- <br />President i <br />South Bend Redevelopment Commission <br />
