The City Engineer submitted the list of the property owners in the <br />matter. of an appropr iat ion ofccerta, in property under 'Condemnet ioh Resolution No. 56 <br />as shown on Page 333 Record No. 8 for the Widening of Ewing Avenue from Ersnperger <br />Street to Olive Street in the City of South Bend, Indiana, which list includes the names <br />of the owners iudd holders of of property and', of interests sought to be taken or bone-, <br />ficially or injuriously affected, and the description of the several pieces of property <br />which is affected by said appropr iat ion proceedings. <br />Thereupon the Board proceeded to award the damages sustained and to <br />assess the benefits accruing to each piece, of property on said list, <br />It was thereupon, upon motion duly made and seconded and unanimously <br />adopted, resolved that said list, together with the amount of benefits and damages and the <br />benefits and net damages therein set forth.as the several parcels of land be adopted and <br />that the respective amount, of benefits contained in said list to and are hereby assessed <br />against the several tracts of land as specifically set forth in said list and that the <br />respective amounts of damages be and are hereby awarded to the several tracts of land <br />as specifically sot forth in said list, and that net benefits or net damages, as the case <br />may be as to the respective tracts of land, contained in said list'are hereby awarded or <br />assessed, as the case may be as to the said several tracts of land. <br />The Board hereby further -sets off the benefits and damages each against <br />the other where both benefits and damages are assessed, against the same piece of property, <br />tract of land or interests, and hereby fixes the said respective net benefits as the amount <br />that shall be paid by the respective owners as benefits and further hereby fixes the <br />resRct ive owners as benefits and further hereby fixes the respective net damages as to the <br />several tracts as the amount that shall be paid to the owners of the respective tract <br />as damages. <br />The Clark of this Board was instructed to prepare notices to the <br />owners of each parcel of property showing the amount of the assessment of benefits or <br />award of damages with a description of the property and it was unanimously agreed by the <br />Board that the date of hearing on said awards of damages or assessments of benefits for <br />this Widening proceedings be set at a future tame. <br />Permission granted the Indiana Bell Telephone Company as follows: - <br />..To To place one anchor in alley between William Street and Franklin street <br />Just south of Wayne Street. Place one anchor in same' alley just north of Division Street. <br />Place one 3 foot pole and anchor in alley between Leland Avenue and North Scott Street <br />just south of Portage Avenue, also place one 3.0 foot pole in same alley .south of Logan <br />Street. <br />Concerning the improvement of the roadway of Lawndale Avenue from North li <br />of Van Buren Street to Vassar Park Addition with asphalt, asphaltic concreto, bitulithic <br />concrete or brick, pursuance to resolution No. 813 the Board finds that no petition has been <br />filed with said Board by a majority in number of the freeholders residing -on said street <br />to be improved requesting that it be'improved with different kind Of pavement than the kind <br />hereotofore adopted by the.Bosrd in its preliminary order; and the City Engineer reports <br />that the Williston Construction Company is the_1owest and best bidders for the kind of pavo- ment heretofore adopted by the Board and the Board find that said Williston Construction <br />Company is the lowest and best bidder and hereby lets the contract for said improvement <br />to him, and orders that said improvement be made with Aspaltic Concrete using Trinidad <br />Lake Asphalt and all proceedings heretofore made in this matter are, hereby confirmed and <br />ratified, <br />Attested: - <br />Veronica C .
