Wednesday August 18th.,1920. Judge Fund appeared before the Board in regard to plat filed May 18th.9 1920 of Meyer's and Funk's Chippewa Heights Add it ion' to South Bend, Indiana. Action deferred on, same until Tuesdays August 24th., 1920 at 10:00 A M. Board to investigate this plat. • Financial report of the Build in Commissioners filed. The following communication received from the Indiana Bell Telophone'Company read and referred to the City Attorney. South Bend, Ind Tana. August 14,1920, Mr. GtBbert A Elliott, Pres., - Board of .Public Workar South Band, Ind iahs, Dear Sir - Confirming my conversation with you concerning the refusal of Thilman Bros. Plumbers` in acknowledging our bill aga ins t 'them for damage to oub underground conduits ar;d cable on May %th., 1920, the repairs amounting to 025.46 which they refuse , t o pay, The: facts of the .case are that this underground Gable began to fail and the trouble WAs located at a point where Thilman Bros, had done some excavation work and the pavement had been repaired. The trouble was lecat4i in the cable at that point and found t4at the conduit had been broken and the cable injured by a pick or some sharp tool. T#e damage was repaired, the labor amounting to the above mentioned ::'figure, which Thilman Bros. absolutely - refused to recognize. It is my understanding that Thilman Bros. have filed a b and wdth the board, - Of Works guseanteeing the utilities against any such damage caused as herein before mentioned Thilmp Bros'. acknowledged to our representative that they did the damage, but would not pay one cent of it.
