Bend, ` J'ust under sto®d that the price contract amts to"something •like $3.83 per sq. yd for top covering of as pha it 'The Mich. St. as pha It f. ounda,t ion and all cost $1.65 per sq. yd. Any business man or firm would not sons ider the Wayne St. improvement just at the peak of inflas ion costs, but wait until Spring of 1921 & then g4 through to, Lincoln Way East. Gentlemen* - The undersigned,, Chicago, South Bend & Northern Indiana Railway Company, des ires to take advantage of the prov is ion of an Act entitled " An Act Concerning Munie IPA Corperat ions, " approved March 6,1905, and .particularly Section'. 255 and all amendatory and supplemental acts thereto providing for the manner of payment of the paving of streets and alleys in cities and towns, for the issuing and sale of bands there- for and for the collection of same, and for sueh purpose hereby expressly waivesall objections on account of illegality or irregularity of the proceedings had for the improvw- merit by paving of South Michigan Street from Ewing Avenue to a point forty feet (40, )` north of Fa iry iew Street,_ in the City of South Bend, Indiana, as designated in Improve- ment Resolution Number 752 adopted by said City, .and request that said city take such action and do such things as may be necessary to entitled the undersigned to take advantage of the provisions of this act, and to include in the amount of 'the bands: to be Issued or sold the entire cost of that part of the paving improvement properly cLavgaable and assessable against the said Company.
