JOSEPH) >: <br />To the Honorable Board, of Public Works, <br />of the City of ,South Bond, Ind iana►, <br />Petition of the New York Central Ra ilr clad Company, f or permission to lay one, <br />add it ional track and rearrange an existing track across the intersection of Olive sand <br />Sample Streets. ` <br />Comes now the pet it-ioner and res ectfuli p y a bows to the Board that it is <br />a duly organized, c orporat ion operating* under and by v irtu.e of the laws of the State of <br />Ind Tana; that it &oea now and has for many gears operated a steam railroad in and thr ough <br />the C. ity of ;-S outh Bend, 'Ind isna; -that it is a common carrierand is subject to the _lairs <br />of the Stateand the United States governing � e��ommon carrier ra ilro&ds; that the New Vork <br />Railroad Company now crosses the intersection of Olive and Samt3e Streets along its <br />r ght of `way, with three tracks, one of which is the main line of the New York Centrv,l <br />Railr'oaad Company's Illinois Div is ion, the other two tracks being for purposes of switching. , <br />Your petitioner would show that the laying of an additional track across <br />said intersection of O1 ive and Sample Streets would increase the eff ie ie iney of the yard <br />r operation and relieve pose"ible congestion and delay at the cooss ing by keeping, <br />swtttchIng movements off the ma in track; that it is therefore 'to the best interest of the <br />City of South Bend and the petitioner 'herein to lay an add it ional track across said <br />interseA ion of Olive and Sample Streets, that the laying of the additional' track <br />involves and makes necessary the rearrangement of one, existing track. <br />The pet it ioner submits. herewith a blue print of `the 'proposed changes, <br />1 attached hereto, made a part hereof and marked " Exhibit As.. <br />WHEREFORE, your pet i°t ioner prays said Board to grant the permiss ion z <br />and authority to construct_ and ma inta in an additional standard guage track across the <br />intersection of OLive and Sample Streets along petitioner's right of way, and <br />to rearrange an existing track which crosses said intersection. <br />THE NEW YORK CENTRAL RAILROAD COMPANY, <br />BY S. Indiana. <br />In the matter of a petition of the New York Central Railroad <br />Company for permission to lay one additional track and to rearrange an existing track <br />across the intersection of Olive Street and Sample Streets. ° <br />R E S O L U T I O N <br />Whereas, the petitioner,, Hew York Central Railroad Company on this:, <br />the 27th. day of October 1920 filed with the Board its petition for peAmfes ion to construct <br />amd maintain an additional track for switching purposes along its right of way, across <br />the intersection of Sample and O1 ive Streets in the City of South Bend, Indiana, and do <br />rearrange one exisiting track at such crossing. <br />Whereas, this board being fully advised in the premises finds that <br />Aa id petitioner is a duly organised corporation operating under and by virtue of the <br />Dews of the State of Indiana, that it does now anct has for many years operated a stew <br />railroad in and through the City of South Boud in4i,,a; that 'it is a e mmon carrier and In <br />abject to the laws od the Statean�d the United governing common carrier, railroads; <br />
