Aubbell appeared before the Board in regard, to petition <br />filed May 27,1920 for permission to construct tracks over Walnut Street and Olive <br />Street W the Northern Indiana R7. Company, same was approved by the Board by resolution <br />as to1 . <br />State of Indiana )SS <br />St. Joseph County ) <br />In the Matter of the Pet it ion <br />of the Ind Tana Northern Railway C ompany, f or <br />permiss ion to construct and operate <br />tracks over Olive- and Walnut Streets in the <br />City of South Bend, Indiana, <br />RESO'LUT I O:N. <br />Whereas, the, pet it loner. Indiana Northern Railway Company, heretofore <br />on the 27th. day of May,1920 filed with this board its petition for permission to con- <br />struct and maintain tracks . over Walnut and Olive Streets in the C its of South Bend, <br />Ind iaan,_ and <br />Whereas, this Board being tuly advised in the premises finds that, <br />said petitioner is a railroad corporation duly crgaxised and ex ist iag" under the laws <br />Of the State of Indiana; that t it Owns and operates a. steam railroad in the City Of South <br />Bend aad that it is a common carrier and is subject to the laws -of the State and of the <br />united States governing common carriers; that it was organised primarily for the purpose <br />of --sery ing the Oliver Chilled Plow Company of the City of South Bead, aad is located <br />aimost ent ire ly within the present plant of said c onpanV. or upon land . ad jaeest thereto, <br />which is to be occupied by said c'Ompany with additional plant buildings and facilities <br />now is pr oeess of construction; 'that is order , to meet the .aeseds of ,said plant when. <br />expanded it will be necessary L to add to pet it ioaer t s present facilities by extend <br />\ its present tracks and constructing new ores; that said tracks will lead to and connect <br />with other lutes of railroad to the east and west of Olive sad Walnut Streets in <br />said City, and in order to make such a onnect ions and operate said tracks it will be <br />necessary to crosss said streets with petitioners tracks at the points ^hereinafter, desI- <br />!gasted_. _ <br />Now, _ therefore, be it r �s olved that said petition be granted and that <br />said pet itioier is hereby gives the right to construct, maintain and operate railroad <br />tracks over and across said Olive and Walnut Streets in said City of South Ben at such <br />times as it may deem them L necessary at the following points:- <br />1. At a point on Walnut Street approximately 700 Feet south\ of the <br />s out hern .l Ise of Sample Street cross ing on a curve of about 20 degrees; tangent to curve <br />at center of the; street not to be less than 60 degrees with the center lute of said <br />street, <br />2.. At a point .on Walnut Street approximately 2100 feet south ,of the <br />s outhera line of Sample -Street and approximately 50 feet north of the north line of the <br />right of way of the St. Joseph,- South Head 7 Southern Railroad Company on a curve of about. <br />20 degrees, tangent to a curve -at center of the street not to be less than 6odegrees with <br />the center line- of said street. <br />-3. A crossing on. Walnut Street parallel with'and immediately adjacent <br />on the north to the right of way of the S. S. 41 8. R. R. <br />4. A crossing on Olive Street parallel with and immediately adjacent <br />on the north to the right of way of the S. S. 41 S.r. R. - <br />5. A erossisg on Olive Street at a point approximately 2100 feet <br />south of the southern line of Sample Street asd approximately 100 feet north of the center <br />Line of "the✓J.Uht of way of the S. S. & S. R. R. Ceon a eurv• of about 20 degrees - <br />tangent to a curve at_ceater ofthestreet not to be less than 60 degroos with the center lih <br />line of said street. - <br />6. At a point on Olive Street apprOXIMstely 670 feet south of the <br />sauthera line of Sample ,Suet.: two straight crossings at,ab®ut right angles to the <br />'obnter l ine of the street. <br />
