Transfer of Rights of Recovery against Others to Us under section A. Loss Conditions is <br />deleted and replaced by the following: <br />5. Transfer of Rights of Recovery against Others to Us <br />If a person or organization to or for whom we make payment under this coverage form has rights to <br />recover damages from another, those rights are transferred to us. That person or organization must do <br />everything necessary to secure our rights and must do nothing after "accident" or "loss" to impair them. <br />However, if the insured has waived rights to recover through a written contract, or if your work was <br />commenced under a letter of intent or work order, subject to a subsequent reduction in writing of such a <br />waiver with customers whose customary contracts require a waiver, we waive any right of recovery we <br />may have under this coverage form. <br />C. The following is added to Condition 2. Concealment, Misrepresentation or Fraud under section B. General <br />Conditions: <br />However, if you unintentionally fail to disclose any hazards at the inception of your policy, we will not deny <br />coverage under this coverage form because of such failure. This provision does not affect our right to <br />collect additional premium or exercise our right of cancellation or non -renewal. <br />D. Paragraph b. of Condition 5. Other Insurance under section B. General Conditions is deleted and replaced <br />by the following: <br />b. For Hired Auto Physical Damage Coverage, the following are deemed to be covered "autos" you own; <br />(1) Any covered "auto" you lease, hire, rent or borrow; and <br />(2) Any covered "auto" hired or rented by your "employee" under a contract in that individual <br />"employee's" name, with your permission, while performing duties related to the conduct of your <br />business.
