WHET <br />the Seca <br />and coun <br />enforcemi <br />together <br />may be & <br />RESOLUTION NO. 321 <br />RESOLUTION APPROVING AND AUTHORIZING THE SUBMISSION OF A <br />CODE ENFORCEMENT GRANT APPLICATION <br />:EAS, Section 117 of the Housing Act of 1949, as amended, authorizes <br />tary of Housing and Urban Development to make grants to municipalities <br />ies to assist them in carrying out programs of concentrated code <br />nt in deteriorated or deteriorating areas in which such enforcement, <br />with certain public improvements to be provided by the locality, <br />pected to arrest the decline of the area; and <br />WHEREAS, it has been found and determined by this body that there <br />exists iii this locality certain deteriorated or deteriorating areas for <br />which a program of concentrated code enforcement, combined with certain <br />public improvements, may be expected to arrest the decline of the area; <br />and <br />WHEREAS, it is recognized that the grant of funds pursuant to Section <br />117 will impose certain obligations and responsibilities upon the City of <br />South Be d, Department of Redevelopment, among which is the obligation to <br />assure that any persons who may be displaced as a result of the code en- <br />forcement and public improvements programs are relocated into decent, safe, <br />and sani ary housing in accordance with the regulations of the Department <br />of Housi g and Urban Development; and <br />WHE EAS, Title VI of the Civil Rights Act of 1964 prohibits discrimination <br />on the b sis of race, color, or national origin under any program or activity <br />receivinj Federal financial assistance and Executive Order 11063 prohibits <br />discrimi ation on basis of race, color, creed or national origin in sale, <br />lease, o other dis osition of residential property (including land intended <br />for resi ential use or in the use or occupancy thereof: <br />NOW THEREFORE, BE IT RESOLVED BY THE South Bend Redevelopment Commission, <br />Governing Body of the City of South Bend, Department of Redevelopment. <br />1. That an application be filed with the Department of Housing and <br />Urban Development on behalf of the City of South Bend, Department of Re- <br />development for a code enforcement grant under Section 117 of the Housing <br />Act of 1949, as amended, of two- thirds of the cost of undertaking and <br />carrying out a code enforcement program, which cost is now estimated to <br />be $968,419..00, in an area or areas to be designated and specially de- <br />scribed n such application, and that the Executive Director is hereby authorized <br />and directed to execute and file such application, to provide such additional <br />information and furnish such documents as may be required by the Department <br />of Housitig and Urban Development, to execute such contract or contracts as <br />may be necessary for the grant applied for, to execute and file requisition <br />for funds, and to act as the authorized representative of the City of South <br />Bend, De artment of Redevelopment in the accomplishment of the code enforce- <br />ment program. <br />2. <br />grant thi <br />level of <br />in any fi <br />areas, tl <br />throughoi <br />filing o- <br />That during the period of the contract for the code enforcement <br />City of South Bend, Department of Redevelopment will maintain a <br />expenditures for code enforcement activities, exclusive of expenditures <br />�derally assisted code enforcement or Title I urban renewal project <br />iat is not less than the average yearly expenditure for such activities <br />it the locality for the two full fiscal years immediately preceding the <br />the application. <br />
