RESOLUTION NO. 346 <br />; ESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING <br />IODY OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENI APPRU M b <br />1ND AUTHORIZING THE SUBMISSION OF A CODE ENFORCEMENT GRANT APPLICATION <br />-OR MODEL CITIES EAST CODE AREA <br />WHEREAS, Section 117 of the Housing Act of 1949, as amended, authorizes the Secretary <br />of Housing and Urban Development to make grants to municipalities and counties to <br />assist them in carrying out programs of concentrated code enforcement in deteriorated <br />or deteriorating areas in which such enforcement, together with certain public <br />improvements to be provided by the locality, may be expected to arrest the decline <br />of the are ; and <br />WHEREAS, i has been found and determined by this body that there exists in this <br />locality certain deteriorated or deteriorating areas for which a program of con- <br />centrated code enforcement, combined with certain public improvements, may be <br />expected to arrest the decline of the area; and <br />WHEREAS, it is recognized that the grant of funds pursuant to Section 117 will <br />impose cer ain obligations and responsibilities upon the City of South Bend, <br />Department of Redevelopment, among which is the obligation to assure that any <br />persons wh may be displaced as a result of the code enforcement and public <br />improvemen s programs are relocated into decent, safe, and sanitary housing in <br />accordance with the regulations of the Department of Housing and Urban Develop- <br />ment; and <br />WHEREAS, T tle VI of the Civil Rights Act of 1964 prohibits discrimination on <br />the basis f race, color, or national origin under any program or activity <br />receiving ederal financial assistance and Executive Order 11246 prohibits <br />discrimina ion on the basis of race, color, creed or national origin in sale, <br />lease, or they disposition of residential property (including land intended <br />for reside tial use) or in the use or occupancy thereof: <br />NOW, THERE�ORE, BE IT RESOLVED BY THE South Bend Redevelopment Commission, Governing <br />Body of th City of South Bend, Department of Redevelopment: <br />1. That an application be filed with the Department of Housing and Urban <br />Development on behalf of the City of South Bend, Department of Redevelopment for <br />a code enforcement grant under Section 117 of the Housing Act of 1949, as amended, <br />of two-thirds of the cost of undertaking and carrying out a code enforcement <br />program, which cost is now estimated to be One Million, Eight Hundred and Thirty <br />Two Thousaild, Three Hundred and Ninety Four ($1,832,394):Dollars in an area or <br />areas to be designated and specially described in such application, and that the <br />Executive Director is hereby authorized and directed to execute and file such ap- <br />plication, to provide such additional information and furnish such documents as <br />may be required by the Department of Hcusin� and Urban Development to execute and <br />file requisition for funds, and to act as the authorized representative of the City <br />of South Bend, Department of Redevelopment in the accomplishment of the code enforce- <br />ment program and the President and Secretary of the Commission are hereby authorized <br />to execute such contract or contracts as may be necessary for the grant applied for. <br />2. Thai; during the period of the contract for the code enforcement grant the <br />City of South Bend, Department of Redevelopment will maintain a level of expenditures <br />for code enforcement activities, exclusive of expenditures in any federally assisted <br />code enforcement of Title I urban renewal project areas, that is not less than the <br />average yearly expenditures for such activities throughout the locality for the two <br />full fiscal years immediately preceding the filing of the application. <br />3.
