<br />RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING
<br />BODY OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT APPROVING
<br />AND AUTHORIZING THE SUBMISSION OF A CODE ENFORCEMENT GRANT APPLICATION
<br />FOR MODEL CITIES WEST CODE AREA
<br />!ction 117 of the Housing Act of 1949, as amended, authorizes the Secretary
<br />and Urban Development to make grants to municipalities and counties to
<br />i in carrying out programs of concentrated code enforcement in deteriorated
<br />�ating areas in which such enforcement, together with certain public im-
<br />to be provided by the locality, may be expected to arrest the decline of

<br />is recognized that the grant of funds pursuant to Section 117 will
<br />,ain obligations and responsibilities upon the City of South Bend,
<br />of Redevelopment, among which is the obligation to assure that any
<br />may be displaced as a result of the code enforcement and public im-
<br />programs are relocated into decent, safe, and sanitary housing in
<br />with the regulations of the Department of Housing and Urban Development;
<br />WHEREAS, TITLE VI of the Civil Rights Act of 1964 prohibits discimination on the
<br />basis of race, color, or national origin under any program or activity receiving
<br />Federal fi ancial assistance and Executive Order 11246 prohibits discrimination
<br />on the bas's of race, color, creed or national origin in sale, lease, or other
<br />dispositiol of residential property (including land intended for residential use)
<br />or in the kse or occupancy thereof:
<br />NOW, THEREFORE, BE IT RESOLVED BY THE South Bend Redevelopment Commission, Governing
<br />Body of th City of South Bend, Department of Redevelopment:
<br />1. That an application be filed with the Department of Housing and Urban
<br />Development on behalf of the City of South Bend, Department of Redevelopment for
<br />a code enf rcement grant under Section 117 of the Housing Act of 1949, as amended,
<br />of two-thirds of the cost of undertaking and carrying out a code enforcement program,
<br />which cost is now estimated to be One Million, Seven Hundred and Twenty Four Thousand,
<br />Five Hundr d and Fifty Six ($1,724,556) Dollars in an area or areas to be designated
<br />and specially described in such application, and that the Executive Director is
<br />hereby aut orized and directed to execute and file such application, to provide
<br />such additional information and furnish such documents as may be required by the
<br />Department of Housing and Urban Development to execute and file requisition for
<br />funds, and to act as the authorized representative of the City of South Bend,
<br />Department of Redevelopment in the accomplishment of the code enforcement program
<br />and the Pr sident and Secretary of the Commission are hereby authorized to execute
<br />such contract or contracts as may be necessary for the grant applied for.
<br />2. That during the period of the contract for the code enforcement grant the
<br />City of So th Bend, Department of Redevelopment will maintain a level of expenditures
<br />for code e forcemeat activities, exclusive of expenditures in any federally assisted
<br />code enfor ement of Title I urban renewal project areas, that is not less than the
<br />average yearly expenditures for such activities throughout the locality for the two
<br />full fiscal years immediately preceding the filing of the application.
<br />3. That the locality has a program for and will provide in a timely manner
<br />all necessary public improvements for the code enforcement area.

<br />ndividuals and families, and it is the sense of this body that such
<br />if any, will be relocated in accordance with applicable requirements
<br />trtment of Housing and Urban Development.
