I <br /> I <br /> APPENDIX III <br /> ST.JOSEPH COUNTY HOUSING CONSORTIUM <br /> AFFIRMATIVE MARKETING PROCEDURES <br /> The HOME program,as defined in 24 CFR Part 92,requires participating jurisdictions to design a <br /> statement of policy and procedures to be followed to meet the requirements for affirmative marketing of <br /> HOME-assisted housing containing five (5) or more units as directed in 24 CFR 92.351. The following <br /> will serve as that policy. <br /> The policies and procedures specified below will pertain to the marketing of units in HOME <br /> projects, for both initial and subsequent tenants, with availability of such units. It is the policy of the <br /> St. Joseph County Housing Consortium to ensure good faith efforts to provide information to and attract <br /> eligible persons from all racial, ethnic, and gender groups in the housing market area to the housing <br /> available. <br /> 1. To inform the public of the St.Joseph Housing Consortium affirmative marketing policy,the Equal <br /> Housing Opportunity logo or slogan will be used in media announcements regarding the availability <br /> ' of Draft or Proposed Housing&Community Development Plans. These notices will appear in the <br /> South Bend Tribune. The affirmative marketing policy and fair housing laws will be addressed <br /> whenever a public meeting is held to describe the general HOME program. <br /> 2. The Consortium contracts with individual member jurisdictions, not-for-profit groups, or other <br /> eligible agencies to carry out the individual programs. Contracts with participating HOME <br /> organizations include a copy of this policy and include language requiring the organizations to <br /> follow the procedures. These participating organizations then have a responsibility to carry out the <br /> Consortium's policy by ensuring: <br /> A. Tenants in units to be rehabilitated are to be informed of the fair housing laws at the same <br /> time the participating organization informs them of its tenant assistance policy. <br /> B. The application for funding form will inform the applicant/owners of the affirmative <br /> marketing policy and fair housing laws when applying for funds through HOME. <br /> C. Compliance with the conditions of the affirmative marketing procedures will be required <br /> by a written agreement between the Consortium and the participating organization and, if <br /> necessary,between the participating organization and the owner. Said agreement shall be <br /> applicable for a period of 5, 10, 15 or 20 years(in accordance with the requirements set out <br /> in 24 CFR 92.252(a)(5) beginning on the date on which all the units in the project are <br /> completed. <br /> D. By virtue of the contractual agreements,the applicants/owners must agree to comply with <br /> Equal Opportunity requirements applicable to the HOME activities. Specifically, the <br /> applicant agrees to comply with: <br /> (1) Title VI, Civil Rights Act of 1964, which provides that no person in the United <br /> States shall on the grounds of race, color, or national origin be excluded from <br /> participation in,be denied the benefits of, or be subjected to discrimination under <br /> any program or activity receiving Federal financial assistance. <br /> (2) Title VIII, Civil Rights Act of 1968, which provides for fair housing throughout <br /> the United States. Kinds of discrimination prohibited: refusal to sell, rent, or <br /> ' negotiate, or otherwise to make unavailable; discrimination in terms, conditions <br /> and privileges; block-busting; discrimination in fmancing and discrimination in <br /> membership in multi-listing services and real estate brokers organization. <br /> 1 Discrimination is prohibited on the grounds of race, color, religion, sex and <br /> national origin.
