CITY OF SOUTH BEND OFFICE OF THE CLERK <br /> Council Attorney Bob Palmer stated, I have a quick question on section six(6). Are you confident <br /> that the surplus funds to assist people being relocated fall within the purposes of the State statute? <br /> Tam Panowicz, Assistant City Attorney with offices located on the 12th floor of the County-City <br /> Building, replied, Yes. The statute that allows for rental inspections specifically says fees have to <br /> be going toward the program's expenses, whereas penalties can go toward the jobs being done. <br /> Council Attorney Palmer stated, I wasn't sure about the State statute. <br /> Mr. Panowicz replied, Yeah, they don't talk about the penalties, they only talk about fees. <br /> Committee Chair Broden stated, Last question, is there reciprocity with the State of Michigan, <br /> with regard to the Indiana Home Inspectors? <br /> Ms. Morgan replied, We weren't able to find that out this afternoon, but we will continue to look <br /> into that. <br /> Committee Chair Broden stated, I need to offer a huge apology. <br /> Committeemember Davis interrupted, Go for it, keep on going. <br /> Committee Chair Broden continued, There is public comment with this. <br /> Committeemember Davis interrupted, I know, we get it. <br /> Committee Chair Broden continued, But, you have to realize, changes came in on Wednesday, <br /> Council gets it on Thursday, and if we are going to make some changes here they should actually <br /> be disclosed before we go to the public portion of this. <br /> Committeemember Davis interrupted, I understand. <br /> Committee Chair Broden went on, So, I think, the best way to handle this, and I am going to <br /> apologize,what we will do is we will take opposition first(1st) for six(6)minutes and then we will <br /> go for those in favor, second (2°1). If you've shown up to speak now, we will have everybody <br /> tonight. <br /> Committeemember Davis interjected, Let's roll. <br /> Committee Chair Broden then opened the floor to members of the public wishing to speak in favor <br /> of or in opposition to this legislation. <br /> Beau Dungby, 1537 Northside Boulevard, stated, I'm an Association Director for the local <br /> Association of Realtors. First (1st), I would like to commend everybody involved. This is <br /> government doing good work. We, as an Association,met with the City staff and got a lot of these <br /> changes put in. There were a couple concerns we wanted to bring forward before we put this <br /> through. I think, overall, we are very much in favor of what everybody is trying to do here with <br /> these homes. They are in serious disrepair.
