RESOL <br />RESOLUTION NO. 374 <br />ON OF THE SOUTH BEND REDEVELOPMENT COMMISSION GOVERNING BODY <br />OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT PROGRAM <br />APPLICATION FOR PROGRAM NO. 1 <br />WHEREAS it is necessary and in the public interest that the City of South <br />Bend Department of Redevelopment avail itself of the financial assistance pro- <br />vided by Title I of the Housing Act of 1949, as amended, to commence a Neighbor- <br />hood Develop ent Program in the urban renewal areas described on Annex No. 1, <br />hereinafter referred to as the "Program;" and <br />WHEREAS it is recognized that the Federal contract for such financial assist- <br />ance pursuant to said Title I will impose certain obligations and responsibilities <br />upon the Local Public Agency and will require among other things (1) the provision <br />of local grants-in-aid; (2) a feasible method for the relocation of individuals <br />and families displaced from the urban renewal areas comprising the Program; and <br />(3) other to al obligations and responsibilities in conneciton with the undertaking <br />and carrying out of the Program; and <br />WHEREAS Title VI of the Civil Rights Act of 1964 prohibits discrimination on <br />the basis of race, color or national origin under any program or activity receiv- <br />ing Federal financial assistance, and Executive Order 11063 prohibits discrimination <br />on basis of race, color, creed or national origin in sale, lease or other disposition <br />of residential property (including land intended for residential use) or in the use <br />or occupancy thereof; and <br />WHEREAS, the Local Public Agency has elected to make relocation payments in <br />excess of $25,000, it is recognized that such payments are to be made in accordance <br />with the reg lations governing relocation payments; and the Local Public Agency has, <br />or will have, available local funds (other than local grants -in -aid or program funds) <br />with which t pay its share of the payments in excess of $25,000, and <br />WHEREAS in those areas where clearance is proposed, the objectives of the <br />Program cann t be achieved through more extensive rehabilitation of the urban renewal <br />areas compri ing the Program. <br />NOW, THEREFO E, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING <br />BODY OF THE ITY OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT: <br />1. That the United States of America and the Secretary of Housing and Urban <br />Development De, and they hereby are, assured of -full compliance by the City of <br />South Bend Department of Redevelopment with regulations of the Department of Housing <br />and Urban Development effectuating Title VI of the Civil Rights Act of 1964 and <br />applicable Executive Orders. <br />2. That an application on behalf of the City of South Bend Department of Re- <br />development, for a loan under Section 102 (a) of said Title I in the amount of <br />$1,118,635.0 and for a program capital grant, a relocation grant, and a Federal <br />grant for the making of a rehabilitation grant to the full amount available for <br />undertaking and financing the first increment of such Program is hereby approved, and <br />that the Exe utive Director is hereby authorized and directed to execute and to file <br />such application with the Department of Housing and Urban Development, to provide <br />such additio al information and to furnish such documents as may be required in <br />behalf of said Department, and to act as the authorized correspondent of the City of <br />South Bend D partment of Redevelopment <br />3. That it is hereby recognized that relocation payments made in excess of <br />$25,000 are to be made in accordance with the regulations governing relocation <br />payments and that the Local Public Agency has, or will have, available local funds <br />(other than local grants -in -aid or project funds) with which to pay its share of the <br />payments in excess of $25,000. <br />Adopted <br />on August 20 <br />227 West Jef <br />ATTEST: <br />VgS E C R <br />REV.
