DocuSign Envelope ID: 295F7F4F-778D-4E36-838C-D2E4BB27ECC8 <br />This is EXHIBIT A, consisting of 10 pages, referred to in <br />and part of the Agreement between Owner and Engineer <br />for Professional Services dated , <br />Enizineer's Services <br />Article 1 of the Agreement is supplemented to include the following agreement of the parties. <br />Engineer shall provide Basic and Additional Services as set forth below. <br />PART 1— BASIC SERVICES <br />A1.01 Right -of -Way Services <br />A. Right -of -Way Management and Supervision <br />1. Engineer shall be responsible for administering, scheduling, and coordinating all <br />activities necessary to certify right-of-way has been acquired and the project is clear <br />for construction letting. This responsibility shall include: <br />a. Meetings, conferences, and communications with property owners, relocatees, <br />attorneys, engineers, appraisers, buyers, and Owner <br />b. Revisions to construction plans, right-of-way plans, plats, legal descriptions, and <br />right-of-way stake -outs that may be required <br />2. These right-of-way services include all reasonable services as required to secure all <br />parcels based on the approved engineering design or to recommend to the Owner that <br />condemnation proceedings be filed. <br />3. The Engineer shall make arrangements for delivery of payment to each property <br />owner and/or relocatee. <br />B. Title Research Services <br />1. Preparation of Title and Encumbrance Reports — Permanent Right -of -Way <br />a. A Title and Encumbrance Report will be provided for each permanent right-of- <br />way parcel. The Title and Encumbrance Report will be created by adequately <br />researching all available records and documenting the research to identify all <br />parties or entities having any ownership interest in the property to be acquired, <br />including an abstract of all pertinent data, legal descriptions, all liens (taxes, <br />mortgages, and recorded judgments), assessments, taxes, and any encumbrances <br />against the property. <br />2.
