LEASE THIS LEASE ( "Lease") is made by and between the City of South Bend, Indiana, Department of Redevelopment, acting by and through the South Bend Redevelopment Commission, (the "Landlord') and The Gordon Group dba Edible Arrangements, (the "Tenant') as of the date of last execution hereof by Landlord or Tenant (the "Effective Date "). WITNESSETH: ARTICLE 1. BASIC LEASE PROVISIONS 1.1. Basic Lease Provisions. The following basic provisions of this Lease (the "Basic Lease Provisions') constitute an integral part of this Lease and are set forth in this Section 1.1 for the convenience of the parties. Each reference in this Lease to a Basic Lease Provision shall be construed to incorporate all of the terms provided for under such provisions. (a) Leased Premises: 123 S. Michigan Street and as further defined in Section 2_1 hereof, consisting of approximately 1,530 square feet of "Floor Area." (b) Tenn: Initial Term of Five (5) Lease Years, as provided for in Sections 3.1 and 3.2 hereof. (c) Tenant's Use: Police Substation. (d) Tenant's Trade Name: Edible Arrangements (or such other trade name taken by the Tenant) (e) Landlord's Address: 1200 County -City Building 227 West Jefferson Boulevard South Bend, Indiana 46601 With copy to: CBRE I Bradley 101 N. Michigan St., Ste 300 South Bend, IN 46601 (f) Tenant's Address: Aft, y ne Fwsinule Number (g) Lease Year: A "Lease Year" shall mean each period of twelve (12) consecutive full months, beginning on the Commencement Date as defined in Section 3.1 (such that if the Commencement Date is not the first day of a calendar month, then the first Lease Year shall begin on the first day of the first calendar month following the Commencement Date, and any partial month in which the Commencement Date occurs will be included within the first Lease Year).
