RESOLUTION NO. 463 <br />RESOLUTION OF THE CITY OF SOUTH BEND, DEPARTMENT <br />OF REDEVELOPMENT AUTHORIZING THE FILING OF AN <br />AMENDATORY APPLICATION FOR AN EARLY CLOSEOUT <br />GRANT AND INCREASED CAPITAL GRANT FOR PROJECT <br />IND. R -57 AND TO INCORPORATE POOLING ARRANGEMENT <br />WITH PROJECT IND. R -66 <br />WHEREAS, it is necessary and in the public interest that the City of South <br />Bend, Department of Redevelopment avail itself of the financial assistance <br />provided by Title I of the Housing Act of 1949, as amended, to carryout the <br />urban renewal project described as the LaSalle Park Urban Renewal Area, and <br />bounded generally as follows: <br />LaSalle Park Project bounded on the west by the alley <br />west of Chicago; bounded on the south by the alley <br />north of Western; bounded on the east by the alley <br />_ east of Meade; bounded on the north by Kankakee <br />Avenue, Washington Street, the LaSalle Park Beck's <br />Lake Park Area, and Linden Street. <br />hereinafter referred to as the "Project "; and <br />WHEREAS, it is recognized that the Federal contract for such financial <br />assistance, pursuant to said Title I, will impose certain obligations and <br />responsibilities upon the Local Public Agency and will require among other <br />things: (1) the provision of local grants -in -aid; (2) feasible method for <br />the relocation of individuals and families displaced from the project area; <br />and (3) other local obligations and responsibilities in connection with the <br />undertaking and carrying out of urban renewal projects; and <br />WHEREAS, Title VI of the Civil Rights Act of 1964 and the regulations of <br />the Department of Housing and Urban Development effectuating that Title, <br />provide that no person shall, on the ground of race, color, sex, or national <br />origin, be excluded from participation in, be denied the benefits of, or be <br />subject to discrimination in the undertaking and carrying out of the urban <br />renewal projects assisted under Title I of the Housing Act of 1949, as <br />amended; and <br />i <br />WHEREAS, the objectives of the Urban Renewal Plan cannot be achieved through <br />more extensive rehabilitation of the Project Area; and <br />WHEREAS, Section 106 (i) of the Housing Act of 1949, as amended recently by <br />Section 213 of the Housing and Urban Development Act of 1970, provides for <br />an early closeout grant and increased capital grant for the early closeout <br />of an urban renewal project if it has been determined that early closeout is <br />in the financial interest of the federal government based upon a projection <br />of future operating expenses exceeding the current fair reuse value of unsold <br />project land, and if the LPA does not expect to be able in the reasonable near <br />future, due to circumstances beyond its control, to dispose of the remaining <br />project land and if all other project activities are completed except non -cash <br />local grant -in -aid activities designated in the third provision to Section 110 <br />(d) under the conditions specified therein; and <br />WHEREAS, the LPA has not provided the full amount of its share in local grants - <br />in -aid and that to rectify such shortages the federal government permits the <br />pooling of local grants -in -aid with another local project which has an amount <br />of local grants -in -aid in excess of its required one -third (1/3) share; <br />NOW THEREFORE, BE IT RESOLVED by the City of South Bend, Redevelopment Commission: <br />1. That the United States of America and the Secretary of Housing and Urban <br />Development be, and they hereby are, assured of full compliance by the <br />- 1 - <br />
