M <br />RESOLUTION #448 <br />wa- <br />RESOLUTION OF SOUTH BEND REDEVELOPMENT COMMISSION GOVERNING BODY OF CITY <br />OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT APPROVING AND PROVIDING FOR LOCAL <br />EXECUTION OF A PROPOSED NEIGHBORHOOD DEVELOPMENT PROGRAM CONTRACT CONSISTING <br />OF A FUNDING AGREEMENT AND MASTER AGREEMENT AND OTHER DOCUMENTS MADE PART OF <br />CONTRACT BY REFERENCE OR ATTACHMENT FOR PROJECT A -10 <br />WHEREAS, under Title I of the amended National Housing Act of 1949, the <br />United States of America (herein called "Government ") has tendered to the <br />South Bend Redevelopment Commission Governing Body of City of South Bend <br />Department of Redevelopment (herein called "Local Public Agency ") a proposed <br />Contract for Neighborhood Development Program designated Ind. A -10 to aid in <br />financing such Program by means of grant and loan from the Government to the <br />Local Public Agency; <br />WHEREAS, the Contract consists of a Funding Agreement based on HUD -3159B and <br />of a Master Agreement which is HUD -3159A as amended to the present and of <br />Federal Labor Standards Provisions which is HUD -3200 as amended to the <br />present and other documents made part of Contract by reference or attachment <br />described in the above - identified contractual.documents; <br />WHEREAS, the Local Public Agency has received and given due consideration to <br />every part of the proposed contract; <br />WHEREAS, the Local Public Agency is duly authorized under and pursuant to the <br />Constitution and statutes of the State of Indiana to undertake and carry out <br />said Program and to execute such proposed Contract; and <br />WHEREAS, under said proposed Contract the Local Public Agency is required, <br />among other things, with respect to this Program to set up promptly and to <br />maintain in one or more banks which are members of the Federal Deposit <br />Insurance Corporation a separate and special account designated "Neighborhood <br />Development Program Expenditures Account; Program Ind. A -10 ", into which <br />account shall be deposited certain funds described in said proposed Contract: <br />BE IT RESOLVED BY The South Bend Redevelopment Commission Governing Body of <br />City of South Bend Department of Redevelopment, South Bend, Indiana as follows: <br />Section 1. The PROPOSED CONTRACT for Neighborhood Development Program Ind. <br />A -10, CONSISTING OF FUNDING AGREEMENT AND MASTER AGREEMENT AND OTHER DOCUMENTS <br />and by which the United States will make grant payments and loan payments in <br />an aggregate amount up to One Million, Thirty -Seven Thousand, Five Hundred <br />Dollars ($1,037,500) to the Local Public Agency in accordance with said Title <br />I and other Federal law including the Uniform Relocation Assistance and Real <br />Property Acquisition Policies Act of 1970, IS HEREBY APPROVED in all respects <br />for Program Ind. A -10 in the City of South Bend, Indiana. <br />Section 2. The PRESIDENT of the Redevelopment Commission is hereby authorized <br />and directed to execute the Contract by signing two conterparts of the Funding <br />Agreement and signing two counterparts of the Master Agreement on behalf of the <br />Local Public Agency, and the SECRETARY is hereby authorized and directed to <br />attest each such execution and the EXECUTIVE DIRECTOR is hereby authorized and <br />directed to send such counterparts to the United States Department of Housing <br />and Urban Development along with such other documents relative to the approval <br />and execution of the Contract as may be requested by the Government. <br />_c <br />
